Both Gai Waterhouse and Tom Waterhouse denied any wrongdoing. Stewards laid two charges against Waterhouse; (1) 'fail to report to the stewards any condition or occurrence that may affect the running of a horse in a race', and (2) 'having failed to keep a record of treatments administered to a horse'.
