Kenyan Constitutional Referendum, 2010
A constitutional referendum was held in Kenya on 4 August 2010. Voters were asked whether they approved of a proposed new constitution, which had been passed by the National Assembly on 1 April 2010. The new constitution was seen as a vital step to avoid a repetition of the violent outbursts after the 2007 general elections. The result was a victory for the "Yes" campaign, with 68.6% of voters approving the constitution. The "No" campaign's main spokesman, Higher Education Minister William Ruto, conceded defeat. The new constitution came into force on 27 August. Background The 1963 constitution was replaced by a new constitution in 1969. This was amended on several occasions, including a 1982 amendment that led to a coup attempt. The amendment saw the addition of a section 2A to the constitution, making Kenya a single-party state under President Daniel arap Moi. Following protests in the late 1980s, section 2A was repealed in 1991, establishing the multi-party state, and ... 2007 Kenyan Presidential Election
General elections were held in Kenya on 27 December 2007. Voters elected the President, and members of the National Assembly. They coincided with the 2007 Kenyan local elections. Incumbent Mwai Kibaki, running on a Party of National Unity (PNU) ticket, defeated Raila Odinga, leader of the Orange Democratic Movement (ODM) and Kalonzo Musyoka of Orange Democratic Movement–Kenya. The elections were strongly marked by ethnic hostility, with Kibaki a member of the traditionally dominant Kikuyu ethnic group, gaining much support amongst the Kikuyu and neighbouring groups in central Kenya, including the Embu and Meru. Odinga, as a member of the Luo ethnic group, succeeded in creating a wider base by building a coalition with regional leaders from the Luhya in Western Kenya, Kalenjin from the Rift Valley and Muslim leaders from the Coast Province. Kibaki was declared the winner with 46% of the vote, and was sworn in at State House on 30 December. However, opposition leader Raila Od ... Kadhi Courts
Kadhi courts or Kadhi's courts are a court system in Kenya that enforce limited rights of inheritance, family, and succession for Muslims. The history of Kadhi courts extends prior to the colonization of East Africa in the 19th century, and the courts continued under British rule and after Kenyan independence in 1963. An estimated 7% to 20% of the population of Kenya is Muslim. In May 2010, a three-judge bench of the High Court ruled that the inclusion of Kadhi courts in current Constitution was illegal and discriminatory. A new Constitution of Kenya approved by referendum on August 4, 2010 establishes the Kadhi court system as a subordinate court under the superior courts of Kenya (Supreme Court, Court of Appeal, and High Court). The language of the new constitution (section 170) states, "There shall be a Chief Kadhi and such number, being not fewer than three, of other Kadhis as may be prescribed under an Act of Parliament....
