Presumption
In the law of evidence, a presumption of a particular fact can be made without the aid of proof in some situations. The invocation of a presumption shifts the Legal burden of proof, burden of proof from one party to the opposing party in a court trial. There are two types of presumption: ''rebuttable presumption'' and ''conclusive presumption''. A rebuttable presumption is assumed true until a person proves otherwise (for example the presumption of innocence). In contrast, a conclusive (or irrebuttable) presumption cannot be refuted in any case (such as defense of infancy in some legal systems). Presumptions are sometimes categorized into two types: presumptions without basic facts, and presumptions with basic facts. In the United States, mandatory presumptions are impermissible in criminal cases, but permissible presumptions are allowed. An example of presumption without basic facts is presumption of innocence. An example of presumption ''with'' basic facts is Declared death in ... [...More Info...]       [...Related Items...]     OR:     [Wikipedia]   [Google]   [Baidu]   |

Given Name
A given name (also known as a forename or first name) is the part of a personal name quoted in that identifies a person, potentially with a middle name as well, and differentiates that person from the other members of a group (typically a family or clan) who have a common surname. The term ''given name'' refers to a name usually bestowed at or close to the time of birth, usually by the parents of the newborn. A ''Christian name'' is the first name which is given at baptism, in Christian custom. In informal situations, given names are often used in a familiar and friendly manner. In more formal situations, a person's surname is more commonly used. The idioms 'on a first-name basis' and 'being on first-name terms' refer to the familiarity inherent in addressing someone by their given name. By contrast, a surname (also known as a family name, last name, or ''gentile name, gentile'' name) is normally inherited and shared with other members of one's immediate family. Regnal names ... Axiom
An axiom, postulate, or assumption is a statement that is taken to be true, to serve as a premise or starting point for further reasoning and arguments. The word comes from the Ancient Greek word (), meaning 'that which is thought worthy or fit' or 'that which commends itself as evident'. The term has subtle differences in definition when used in the context of different fields of study. As defined in classic philosophy, an axiom is a statement that is so evident or well-established, that it is accepted without controversy or question. As used in modern logic, an axiom is a premise or starting point for reasoning. As used in mathematics, the term ''axiom'' is used in two related but distinguishable senses: "logical axioms" and "non-logical axioms". Logical axioms are usually statements that are taken to be true within the system of logic they define and are often shown in symbolic form (e.g., (''A'' and ''B'') implies ''A''), while non-logical axioms (e.g., ) are actually ...
