Circumvention Device
Anti-circumvention refers to laws which prohibit the circumvention of technological barriers for using a digital good in certain ways which the rightsholders do not wish to allow. The requirement for anti-circumvention laws was globalized in 1996 with the creation of the World Intellectual Property Organization's Copyright Treaty. Digital Rights Management
Digital rights management (DRM) is the management of legal access to digital content. Various tools or technological protection measures (TPM) such as access control technologies can restrict the use of proprietary hardware and copyrighted works. DRM technologies govern the use, modification, and distribution of copyrighted works (such as software and multimedia content), as well as systems that enforce these policies within devices. Laws in many countries criminalize the circumvention of DRM, communication about such circumvention, and the creation and distribution of tools used for such circumvention. Such laws are part of the United States' Digital Millennium Copyright Act (DMCA), and the European Union's Information Society Directive (the French DADVSI is an example of a member state of the European Union implementing the directive). DeCSS
DeCSS is one of the first free computer programs capable of decrypting content on a commercially produced DVD video disc. Before the release of DeCSS, open source operating systems (such as BSD and Linux) could not play encrypted video DVDs. DeCSS's development was done without a license from the DVD Copy Control Association (CCA), the organization responsible for DVD copy protection—namely, the Content Scramble System (CSS) used by commercial DVD publishers. The release of DeCSS resulted in a Norwegian criminal trial and subsequent acquittal of one of the authors of DeCSS. The DVD CCA launched numerous lawsuits in the United States in an effort to stop the distribution of the software. Origins and history DeCSS was devised by three people, two of whom remain anonymous. ''Stevens v Kabushiki Kaisha Sony Computer Entertainment'', was a decision of the High Court of Australia concerning the "anti-circumvention" provisions of the Copyright Act 1968. The appellant, Stevens, had sold and installed modchips that circumvented the Sony PlayStation's copy protection mechanism. Sony argued that Stevens had knowingly sold or distributed a "circumvention device" which was capable of circumventing a "technological protection measure", contrary to s 116A of the ''Copyright Act''. At first instance, the Federal Court (Sackville J) held that the relevant copy protection feature was not a "technological protection measure" and refused Sony's application for relief under s 116A.. The burden of proof requires a party to produce evidence to establish the truth of facts needed to satisfy all the required legal elements of the dispute.
