Tract Index
A tract index is a document which summarizes real property transactions in certain U.S. states and may be available in the offices of Recorder of deeds. Layout and content The information is organized by section, with a section relating to one square mile. Each section is presented in a two-page representation, usually by presenting the northwest quarter-section as the top half of the left page. The other quarter-sections are placed in map relationship to the northwest. In each quarter-section area, all transfers are listed in chronological order, often regardless of any subdivisions of the quarter-section. Each entry includes several cross-reference details, such as the names of the grantor (seller) and grantee (purchaser), the description of the parcel, the volume and page of the Deed books, the date, and other identifying characteristics of the transfer (for example, the type of deed). Real Estate Transaction
A real estate transaction is the process whereby rights in a unit of property (or designated real estate) is transferred between two or more parties, e.g. in case of conveyance one party being the seller(s) and the other being the buyer(s). It can often be quite complicated due to the complexity of the property rights being transferred, the amount of money being exchanged, and government regulations. Conventions and requirements also vary considerably among different countries of the world and among smaller legal entities ( jurisdictions). In more abstract terms, a real estate transaction, like other financial transactions, causes transaction costs. South Dakota
South Dakota (; Sioux: , ) is a U.S. state in the North Central region of the United States. It is also part of the Great Plains. A grant, in law, is a transfer of property, generally from a person or other entity giving the property (the grantor) to a person or entity receiving the property (the grantee). Historically, a grant was a transfer by deed of that which could not be passed by livery, an act evidenced by letters patent under the Great Seal, granting something from the king to a subject, and a technical term made use of in deeds of conveyance of lands to import a transfer. A mortgage is a legal instrument of the common law which is used to create a security interest in real property held by a lender as a security for a debt, usually a mortgage loan. '' Hypothec'' is the corresponding term in civil law jurisdictions, albeit with a wider sense, as it also covers non-possessory lien. A mortgage in itself is not a debt, it is the lender's security for a debt. Deed
In common law, a deed is any legal instrument in writing which passes, affirms or confirms an interest, right, or property and that is signed, attested, delivered, and in some jurisdictions, sealed. It is commonly associated with transferring ( conveyancing) title to property. The deed has a greater presumption of validity and is less rebuttable than an instrument signed by the party to the deed. A deed can be unilateral or bilateral. Deeds include conveyances, commissions, licenses, patents, diplomas, and conditionally powers of attorney if executed as deeds. The deed is the modern descendant of the medieval charter, and delivery is thought to symbolically replace the ancient ceremony of livery of seisin. Deeds Registration
Deeds registration is a land management system whereby all important instruments which relate to the common law title to parcels of land are registered on a government-maintained register, to facilitate the transfer of title. The system had been used in some common law jurisdictions and continues to be used in some jurisdictions, including most of the United States. It is being replaced by Torrens systems in many jurisdictions. Australia, Ireland as well as most Canadian provinces have converted from deeds registries to Torrens titles. Some Canadian provinces have never operated a deeds registry and have always used Torrens titles.
