Family Mediation
Family mediation is a member of the ADR or alternative dispute resolution family. It forms one of the core pillars of mediation services provided globally. Historically, it remains unclear where family mediation first evolved geographically. However, family mediation has been present in various forms in various cultures world-wide for thousands of years. The family-mediation system focuses on providing a dispute-resolution mechanism to families who are in dispute. Divorce mediation forms part of the family mediation tree of services. Modern-day family mediation is divided into two main fields - mediation and co-mediation. In the former of the two fields a single mediator works with the family in dispute. In the latter of the two fields, two or more mediators work with a family in dispute. Mediations are completed by the use of either joint or single caucuses. Alternative Dispute Resolution
Alternative dispute resolution (ADR), or external dispute resolution (EDR), typically denotes a wide range of dispute resolution processes and techniques that parties can use to settle disputes with the help of a third party. They are used for disagreeing parties who cannot come to an agreement short of litigation. However, ADR is also increasingly being adopted as a tool to help settle disputes within the court system. Despite historic resistance to ADR by many popular parties and their advocates, ADR has gained widespread acceptance among both the general public and the legal profession in recent years. Mediation
Mediation is a structured, interactive process where an impartial third party neutral assists disputing parties in resolving conflict through the use of specialized communication and negotiation techniques. All participants in mediation are encouraged to actively participate in the process. Mediation is a "party-centered" process in that it is focused primarily upon the needs, rights, and interests of the parties. The mediator uses a wide variety of techniques to guide the process in a constructive direction and to help the parties find their optimal solution. A mediator is facilitative in that she/he manages the interaction between parties and facilitates open communication. Divorce
Divorce (also known as dissolution of marriage) is the process of terminating a marriage or marital union. Family Mediation In Germany
In Germany, family law was one of the first areas to establish the thought of mediation, and still is the main field of application of mediation. Conflicts in Family Law are characterized by a high rate of personal conflicts. A possible definition of conflict might be: ''Conflict means … the perceived differences of interests or the conviction that the actual aspirations of the parties can no be received at the same time.'' Basis for personal disputes is the fact that conflicting parties don't come to their own in their personal relationships.
