Periodic Review Secretariat
The Periodic Review Secretariat is a body authorized by President Barack Obama in Executive Order 13567, on March 7, 2011. The Secretariat oversees Periodic Review Boards. The Boards convene hearings to make recommendations about selected individuals held in extrajudicial detention in the United States Guantanamo Bay detention camps, in Cuba. In January 2009 Obama authorized another body, the Guantanamo Review Task Force, to review the files on all the remaining individuals being held in Guantanamo. That body's mandate was to recommend classifying the men into three different groups: individuals who should face charges; individuals who it would be safe to release; and individuals for whom there was no evidence to justify charges, who nevertheless should be held indefinitely, because it was too dangerous to release them. Executive Order 13567
Executive Order 13567 was signed by President Barack Obama on March 7, 2011. Entitled "Periodic Review of Individuals Detained at Guantánamo Bay Naval Station Pursuant to the Authorization for Use of Military Force", its purpose was to establish a process for review of the cases for all detainees at Guantanamo Bay detention camp to establish whether their continued detention is "necessary to protect against a significant threat to the security of the United States", and make recommendations for transfer if not. Executive Order 13567 followed Executive Order 13492 and Executive Order 13493, Executive Order (United States), executive orders President Obama signed on January 21, 2009, the day after he assumed office. Periodic Review Board
The Periodic Review Boards administrate a US ''"administrative procedure"'' for recommending whether certain individuals held in the Guantanamo Bay detention camps, in Cuba are safe to release or transfer, or whether they should continue to be held without charge. The boards are authorized by and overseen by the Periodic Review Secretariat, which United States President, President Barack Obama set up with Executive Order 13567 on March 7, 2011. Extrajudicial Detention
Administrative detention is arrest and detention of individuals by the state without trial. A number of jurisdictions claim that it is done for security reasons. Many countries claim to use administrative detention as a means to combat terrorism or rebellion, to control illegal immigration, or to otherwise protect the ruling regime. In a number of jurisdictions, unlike criminal incarceration (imprisonment) imposed upon conviction following a trial, administrative detention is a forward-looking mechanism. While criminal proceedings have a retrospective focus – they seek to determine whether a defendant committed an offense in the past – the reasoning behind administrative detention often is based upon contentions that the suspect is likely to pose a threat in the future. Guantanamo Bay Detention Camp
The Guantanamo Bay detention camp ( es, Centro de detención de la bahía de Guantánamo) is a United States military prison located within Guantanamo Bay Naval Base, also referred to as Guantánamo, GTMO, and Gitmo (), on the coast of Guantánamo Bay in Cuba. Of the roughly 780 people detained there since January 2002 when the military prison first opened after the September 11 attacks, 735 have been transferred elsewhere, 35 remain there, and 9 have died while in custody. The camp was established by U.S. President George W. Bush's administration in 2002 during the War on Terror following the September 11, 2001 attacks. Indefinite detention without trial led the operations of this camp to be considered a major breach of human rights by Amnesty International, and a violation of the Due Process Clause of the Fifth and Fourteenth amendments of the United States Constitution by the Center for Constitutional Rights. Guantanamo Review Task Force
The Guantanamo Review Task Force was created by Executive Order 13492 issued by President of the United States Barack Obama on January 22, 2009, his second full day in office. United States Attorney General Eric Holder announced Matthew G. Olsen as Executive Director of the task force on February 20, 2009. The task force was charged with determining which Guantánamo detainees can be transferred (released), which can be prosecuted for crimes they may have committed, and, if neither of those is possible, recommending other lawful means for disposition of the detainees. The task force was an inter-agency task force, with the U.S. Department of Justice coordinating the efforts of officials from the U.S. Department of Defense, the U.S. Department of State, and the Department of Homeland Security. Parole Boards
A parole board is a panel of people who decide whether an offender should be released from prison on parole after serving at least a minimum portion of their sentence as prescribed by the sentencing judge. Parole boards are used in many jurisdictions, including the United Kingdom, the United States, and New Zealand. A related concept is the board of pardons and paroles, which may deal with pardons and commutations as well as paroles. A parole board consists of people qualified to make judgements about the suitability of a prisoner for return to free society.
