PFI Convention
The PFI Convention was a multilateral treaty between the old and new member states of the European Union on the topic of fraud and came into force on 17 October 2002. The full name of the treaty is the Convention on the protection of the European Communities' financial interests. It was introduced by the ''Council Act of 26 July 1995 drawing up the Convention on the protection of the European Communities' financial interests''. This convention harmonised the legal definition and criminal liability of fraud and replaced the old European treaties on fraud. It created a unified definition of fraud, and signatory states were to ensure that criminal sanctions were in effect for it. All EU Member states have ratified the convention, and it is available for accession by any future incoming EU member state. Member States
A member state is a state that is a member of an international organization or of a federation or confederation. Since the World Trade Organization (WTO) and the International Monetary Fund (IMF) include some members that are not sovereign states, neither organization ever speaks of "member states". The WTO has simply "members" (see WTO members), and the IMF refers to its members as "member countries". Fraud
In law, fraud is intentional deception to secure unfair or unlawful gain, or to deprive a victim of a legal right. Fraud can violate civil law (e.g., a fraud victim may sue the fraud perpetrator to avoid the fraud or recover monetary compensation) or criminal law (e.g., a fraud perpetrator may be prosecuted and imprisoned by governmental authorities), or it may cause no loss of money, property, or legal right but still be an element of another civil or criminal wrong. Opt-out
The term opt-out refers to several methods by which individuals can avoid receiving unsolicited product or service information. This option is usually associated with direct marketing campaigns such as e-mail marketing or direct mail. A list of those who have opted out is called a Robinson list. Telemarketing The U.S. Federal Government created the United States National Do Not Call Registry to reduce the telemarketing calls consumers receive at home. Initially numbers listed on the registry were due to be kept for five years but will now remain on it permanently due to the Do-Not-Call Improvement Act of 2007, which became law in February 2008. The UK's Direct Marketing Association operates a voluntary opt-out scheme through the Telephone Preference Service, which was established in 1995. Fraud Act 2006
The Fraud Act 2006 (c 35) is an Act of the Parliament of the United Kingdom which affects England and Wales and Northern Ireland. It was given royal assent on 8 November 2006, and came into effect on 15 January 2007. Purpose The Act gives a statutory definition of the criminal offence of fraud, defining it in three classes - fraud by false representation, fraud by failing to disclose information, and fraud by abuse of position. It provides that a person found guilty of fraud was liable to a fine or imprisonment for up to twelve months on summary conviction (six months in Northern Ireland), or a fine or imprisonment for up to ten years on conviction on indictment. This Act largely replaces the laws relating to obtaining property by deception, obtaining a pecuniary advantage and other offences that were created under the Theft Act 1978.
