Missouri Plan
The Missouri Plan (originally the Missouri Nonpartisan Court Plan, also known as the merit plan, or some variation) is a method for the selection of judges. It originated in Missouri in 1940 and has been adopted by many states of the United States. Similar methods are used in some other countries. Under the Plan, a non-partisan commission reviews candidates for a judicial vacancy. The commission then sends to the governor a list of candidates considered best qualified. The governor then has sixty days to select a candidate from the list. If the governor does not make a selection within sixty days, the commission makes the selection. At the general election soonest after the completion of one year's service, the judge must stand in a retention election. If a majority votes against retention, the judge is removed from office, and the process starts anew. Otherwise, the judge serves out a full term. Tennessee Plan
The Tennessee Plan is a system used to appoint and elect appellate court judges in Tennessee. It is largely patterned after the Missouri Plan, and an earlier version in Tennessee was called the Modified Missouri Plan. At the next general election following a judicial appointment to the highest courts, and at the end of every eight-year term, voters' input occurs by deciding whether each judge shall be retained through a yes-no retention election. This system applies to the Tennessee Supreme Court, the Tennessee Court of Appeals, and the Tennessee Court of Criminal Appeals. The next regular election for state judges will be in August 2022. A judicial nominating commission (also judicial nominating committee, judicial nominating board) in the United States, is a body used by some U.S. states to recommend or select potential justices and judges for appointments by state governments. Judicial nominating commissions are often established by the state constitution as part of merit selection plans. They are designed to be independent bodies. A common procedure is for the commission to receive applications for that position and forward three names to the governor, who has some number of days (often 60) to select one. Elbert A. Walton Jr. (born February 21, 1942) is a former American lawyer and politician. Walton was born on February 21, 1942, and graduated from the University of Missouri–St. Louis. He was admitted to the Missouri state bar in 1974. Walton served in the Missouri House of Representatives from 1979 to 1993 as a Democrat.
