Khaliq V HM Advocate
''Khaliq and Anor v HMA'' was a Scottish criminal case decided by the High Court of Justiciary on appeal, in which it was decided that it was an offence at common law to supply materials that were otherwise legal in the knowledge that they would be used for self-harm. Two shopkeepers in Glasgow were arrested and charged, ''inter alia'', with supplying to children ‘glue-sniffing kits’ consisting of a quantity of petroleum-based glue in a plastic bag. They had been previously warned by the police to stop supplying the kits. They gave notice of objection to the indictment, averring that, on the charge of supplying, the facts as libelled did not disclose a crime known to Scots law because there was nothing illegal about the items that they had supplied. The High Court of Justiciary is the supreme criminal court in Scotland. The High Court is both a trial court and a court of appeal. As a trial court, the High Court sits on circuit at Parliament House or in the adjacent former Sheriff Court building in the Old Town in Edinburgh, or in dedicated buildings in Glasgow and Aberdeen. Inhalants are a broad range of household and industrial chemicals whose volatile vapors or pressurized gases can be concentrated and breathed in via the nose or mouth to produce intoxication, in a manner not intended by the manufacturer. George Emslie, Baron Emslie
George Carlyle Emslie, Baron Emslie, (6 December 1919 – 21 November 2002) was a Scottish judge. Educated at the High School of Glasgow and the University of Glasgow, he was commissioned in the Argyll and Sutherland Highlanders and served in World War II in North Africa, Italy, Greece and Austria, rising to the rank of brigade major from 1944 to 1946. He was made a Member of the Order of the British Empire (MBE) in 1946. He became an advocate in 1948 and served as an Advocate Depute from 1955. He became a Queen's Counsel in 1957. He was Sheriff of Perth and Angus from 1963 to 1966 and Dean of the Faculty of Advocates from 1965 to 1970.
