Executive Order 13128
Executive Order 13128 is a United States executive order (EO) issued by Bill Clinton in 1999. It authorized the Departments of State and Commerce to create regulations regarding the implementation of the Chemical Weapons Convention. Background The United States Senate ratified U.S. participation in the Chemical Weapons Convention (CWC) on April 25, 1997. On October 25, 1998 the U.S. Congress passed the Chemical Weapons Implementation Act of 1998, legislation which formally implemented the treaty's many provisions. Among those provisions were requirements for signatories to develop new regulations to deal with the transfer of chemicals and technologies that can be used for chemical warfare purposes.Block, Dennis J., and Epstein, Michael A. In the United States, an executive order is a directive by the president of the United States that manages operations of the federal government. The legal or constitutional basis for executive orders has multiple sources. Article Two of the United States Constitution gives presidents broad executive and enforcement authority to use their discretion to determine how to enforce the law or to otherwise manage the resources and staff of the executive branch. Chemical Weapons Convention
The Chemical Weapons Convention (CWC), officially the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, is an arms control treaty administered by the Organisation for the Prohibition of Chemical Weapons (OPCW), an intergovernmental organization based in The Hague, The Netherlands. The treaty entered into force on 29 April 1997, and prohibits the large-scale use, development, production, stockpiling and transfer of chemical weapons and their precursors, except for very limited purposes (research, medical, pharmaceutical or protective). The main obligation of member states under the convention is to effect this prohibition, as well as the destruction of all current chemical weapons. A chemical substance is a form of matter having constant chemical composition and characteristic properties. Some references add that chemical substance cannot be separated into its constituent elements by physical separation methods, i.e., without breaking chemical bonds. Executive Order 11850
Executive Order 11850 - Renunciation of certain uses in war of chemical herbicides and riot control agents. was signed on April 8, 1975, by United States President Gerald Ford. The executive order restricted the use of herbicides, and riot control agents, including tear gas. Each and every use would require the explicit approval. On April 11, 2007 Joseph Benkert, a George W. Bush political appointee, informed the Senate Armed Services Committee that the Bush Presidency felt it could reinterpret the Executive Order and loosen the restriction on the use of gas as a riot control agent. Geneva Protocol
The Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or other Gases, and of Bacteriological Methods of Warfare, usually called the Geneva Protocol, is a treaty prohibiting the use of chemical and biological weapons in international armed conflicts.
