Duma Kumalo
Duma Joshua Kumalo (died 3 February 2006) was a South African human rights activist and one of the Sharpeville Six. He was condemned to death under the 1984 law of "common purpose", which allowed a person to be convicted for having been in the vicinity of an offence, without personally committing it. In 1988, he received a stay of execution the day before sentence was to be carried out. Following his release from jail in 1991, Kumalo became involved in many human rights activities, including discussions about the Truth and Reconciliation Commission (South Africa), Truth and Reconciliation Commission and work with Amnesty International. He was a founder member of the Khulumani Support Group for victims of apartheid-related violence. Kumalo also became involved in theatre and film projects as a way of telling his story and engaging others with human rights issues. Sharpeville Six
The Sharpeville Six were six South African protesters convicted of the murder of Deputy Mayor of Sharpeville, Kuzwayo Jacob Dlamini, and sentenced to death. History On September 3, 1984, a protest march in Sharpeville turned violent (some of the crowd threw stones at Dlamini's house, he responded by firing a gun and a riot ensued) and the Deputy Mayor was murdered. Mojalefa Sefatsa, Theresa Ramashamola, Reid Mokoena, Oupa Diniso, Duma Khumalo and Francis Don Mokhesi were arrested in the following months, found guilty of murder under the "Common purpose" doctrine and sentenced to death by hanging on December 12, 1985. Common Purpose
The doctrine of common purpose, common design, joint enterprise, joint criminal enterprise or parasitic accessory liability is a common law legal doctrine that imputes criminal liability to the participants in a criminal enterprise for all reasonable results from that enterprise. The common purpose doctrine was established in English law, and later adopted in other common-law jurisdictions including Scotland, Ireland, Australia, Trinidad and Tobago, the Solomon Islands, Texas, Massachusetts, the International Criminal Court, and the International Criminal Tribunal for the former Yugoslavia. Common design also applies in the law of tort. It is a different legal test from that which applies in the criminal law. Truth And Reconciliation Commission (South Africa)
The Truth and Reconciliation Commission (TRC) was a court-like restorative justice body assembled in South Africa in 1996 after the end of apartheid. Authorised by Nelson Mandela and chaired by Desmond Tutu, the commission invited witnesses who were identified as victims of gross human rights violations to give statements about their experiences, and selected some for public hearings. Perpetrators of violence could also give testimony and request amnesty from both civil and criminal prosecution. The TRC was seen by many as a crucial component of the transition to full and free democracy in South Africa. Despite some flaws, it is generally (although not universally) thought to have been successful. Amnesty International (also referred to as Amnesty or AI) is an international non-governmental organization focused on human rights, with its headquarters in the United Kingdom. ''The Story I Am About to Tell'' was a successful South African play by Duma Kumalo. Produced by a support group for survivors giving testimony at the Truth and Reconciliation Commission (South Africa), Truth and Reconciliation Commission, and starring three of them, it ran for five years both at home and abroad. Concept The play was designed for travel around and between communities small and large to spread awareness about the Commission and engage citizens in debate around the questions that it raised. The first of the three genuine TRC witnesses was the mother of a lawyer whose head had exploded after his boobytrapped Walkman detonated. Her testimony included a description of a hands-and-knees crawl into the room in which the bloodied mess of body and head remained.
