Colorado Amendment 41 (2006)
Amendment 41 is a citizen initiative adopted by Colorado voters in the 2006 general election. Amendment 41 has three main sections. Amendment 41's "gift ban" places new restrictions on gifts, broadly defined, given to Colorado state and local elected officials and employees in executive and legislative branches. Such persons are prohibited from receiving gifts with value exceeding $53 per year, subject to an adjustment for inflation. Gifts from lobbyists are banned regardless of amount. There are several exceptions to the gift ban, including an exception for gifts given between personal friends and relatives on special occasions and another for travel paid for by non-profits that receive less than 5% of their revenue from corporate donations or by other state or local governments. Amendment 41's "anti-revolving door" provision prohibits statewide elected officeholders from lobbying certain state elected officials for pay for two years after leaving office. Initiative
In political science, an initiative (also known as a popular initiative or citizens' initiative) is a means by which a petition signed by a certain number of registered voters can force a government to choose either to enact a law or hold a public vote in the legislature in what is called indirect initiative, or under direct initiative, where the proposition is put to a plebiscite or referendum, in what is called a ''Popular initiated Referendum'' or citizen-initiated referendum. In an indirect initiative, a measure is first referred to the legislature, and then put to a popular vote only if not enacted by the legislature. If the proposed law is rejected by the legislature, the government may be forced to put the proposition to a referendum. United States General Election, 2006
The 2006 United States elections were held on Tuesday, November 7, 2006, in the middle of Republican President George W. Bush's second term. Democrats won control of both houses of Congress, which was the first and only time either party did so since the 1994 elections. These elections were widely categorized as a Democratic wave. In the Senate, Democrats won a net gain of six seats to take a narrow majority in that chamber. Democrats picked up 31 seats in the House of Representatives, and after the election Nancy Pelosi became the first female Speaker of the House. In the gubernatorial elections, Democrats won a net gain of six seats. Nationwide, Republicans failed to win any congressional or gubernatorial seat that was held by a Democrat going into the election. Ripeness
In United States law, ripeness refers to the readiness of a case for litigation; "a claim is not ripe for adjudication if it rests upon contingent future events that may not occur as anticipated, or indeed may not occur at all." For example, if a law of ambiguous quality has been enacted but never applied, a case challenging that law lacks the ripeness necessary for a decision. The goal is to prevent premature adjudication; if a dispute is insufficiently developed, any potential injury or stake is too speculative to warrant judicial action. Ripeness issues most usually arise when a plaintiff seeks anticipatory relief, such as an injunction.
