Color Trademark
A colour trade mark (British English) or color trademark (American English) is a non-conventional trade mark where at least one colour is used to perform the trade mark function of uniquely identifying the commercial origin of products or services. In recent times colours have been increasingly used as trade marks in the marketplace. However, it has traditionally been difficult to protect colours as trademarks through registration, as a colour as such was not considered to be a distinctive 'trademark'. This issue was addressed by the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights, which broadened the legal definition of trademark to encompass "any sign...capable of distinguishing the goods or services of one undertaking from those of other undertakings" (article 15(1)). Non-conventional Trademark
A non-conventional trademark, also known as a nontraditional trademark, is any new type of trademark which does not belong to a pre-existing, conventional category of trade mark, and which is often difficult to register, but which may nevertheless fulfill the essential trademark function of uniquely identifying the commercial origin of products or services. The term is broadly inclusive as it encompasses marks which do not fall into the conventional set of marks (e.g. those consisting of letters, numerals, words, logos, pictures, symbols, or combinations of one or more of these elements), and therefore includes marks based on appearance, shape, sound, smell, taste and texture. Trademark Trial And Appeal Board
The Trademark Trial and Appeal Board (TTAB) is an administrative tribunal within the United States Patent and Trademark Office (USPTO). The TTAB is empowered to determine the right to register a trademark. It has no authority to determine the right to use one, nor broader questions of infringement, unfair competition, damages or injunctive relief. The TTAB decides ''ex parte'' appeals from decisions by USPTO Examiners denying registration of marks, and inter partes proceedings challenging the registration of marks. Decisions of the TTAB may be appealed to a United States district court, or to the United States Court of Appeals for the Federal Circuit. Tiffany Blue
Tiffany Blue is the colloquial name for the light medium robin egg blue color associated with Tiffany & Co., the New York City jewelry company created by Charles Tiffany and John Young in 1837. The color was used on the cover of Tiffany's ''Blue Book'', first published in 1845. Since then, Tiffany & Co. has used the color extensively on promotional materials like boxes and bags. Since 1998, the Tiffany Blue color has been registered as a color trademark by Tiffany & Co. Milka
Milka is a brand of chocolate confectionery, originally made in Switzerland in 1901 by Suchard. It has then been produced in Lörrach, Germany for the past 100 years. Since 2012 it has been owned by US-based company Mondelez International, when it started following the steps of its predecessor Kraft Foods Inc., which had taken over the brand in 1990. It is sold in bars and a number of novelty shapes for Easter and Christmas. Products with the ''Milka'' brand also include chocolate-covered cookies and biscuits. Lilac is a color that is a pale violet tone representing the average color of most lilac flowers. The colors of some lilac flowers may be equivalent to the colors shown below as ''pale lilac'', ''rich lilac'', or ''deep lilac''. However, there are other lilac flowers that are colored red-violet. Magenta
Magenta () is a color that is variously defined as pinkish- purplish- red, reddish-purplish-pink or mauvish-crimson. On color wheels of the RGB (additive) and CMY (subtractive) color models, it is located exactly midway between red and blue. It is one of the four colors of ink used in color printing by an inkjet printer, along with yellow, black, and cyan, to make all other colors. The tone of magenta used in printing is called "printer's magenta". It is also a shade of purple.
