Automatic Visa Revalidation
Automatic visa revalidation is one of a handful of exceptions to the general rule that a person who is not a United States citizen or lawful permanent resident can only lawfully enter the United States if he/she has a valid visa. According to automatic visa revalidation, people on some non-immigrant visa statuses who visit Canada, Mexico or some adjacent islands close to the United States for a period of less than 30 days can re-enter the United States based on a valid Form I-94 even if their visa has expired. Rules A person is eligible for automatic visa revalidation provided the following conditions are met: * The underlying authorization for the current status continues to be valid (such as the Form I-129 for non-immigrant workers or Form I-20 for students in F status). * The person’s absence from the United States was 30 days or less. * The person did not visit any countries other than Mexico or Canada in that period. Form I-94
Form I-94, the Arrival-Departure Record Card, is a form used by U.S. Customs and Border Protection (CBP) intended to keep track of the arrival and departure to/from the United States of people who are not United States citizens or lawful permanent residents (with the exception of those who are entering using the Visa Waiver Program or Compact of Free Association, using Border Crossing Cards, re-entering via automatic visa revalidation, or entering temporarily as crew members). While the form is usually issued by CBP at ports of entry or deferred inspection sites, USCIS can issue an equivalent as part of the Form I-797A approval notice for a Form I-129 petition for an alien worker or a Form I-539 application for extension of stay or change of status (in the case that the alien is already in the United States). "State Sponsors of Terrorism" is a designation applied by the United States Department of State to countries which the Department alleges to have "repeatedly provided support for acts of international terrorism". Inclusion on the list imposes strict unilateral sanctions. The State Department is required to maintain the list under section 1754(c) of the National Defense Authorization Act for Fiscal Year 2019, section 40 of the Arms Export Control Act, and section 620A of the Foreign Assistance Act. As of 2021, the list consists of Cuba, Iran, North Korea, and Syria. Countries formerly on the list were Iraq, Libya, South Yemen, and Sudan.
