Morton V. Mancari
''Morton v. Mancari'', 417 U.S. 535 (1974), was a United States legal case about the constitutionality, under the Fifth Amendment, of hiring preferences given to Indians within the Bureau of Indian Affairs. The Supreme Court of the United States held that the hiring preferences given by the United States Congress does not violate the Due Process Clause of the Fifth Amendment. Background The appellees were a group of non-Indian employees of the Bureau of Indian Affairs (BIA). The Appellees brought this action claiming that the employment preference for qualified Indians in the BIA provided by the Indian Reorganization Act of 1934 also known as the Wheeler-Howard Act, 48 Stat. 984, contravened the anti-discrimination provisions of the Equal Employment Opportunity Act of 1972 and deprived them of property rights without due process of law in violation of the Fifth Amendment. The Civil Rights Act of 1964 () is a landmark civil rights and labor law in the United States that outlaws discrimination based on race, color, religion, sex, and national origin. It prohibits unequal application of voter registration requirements, racial segregation in schools and public accommodations, and employment discrimination. The act "remains one of the most significant legislative achievements in American history". Initially, powers given to enforce the act were weak, but these were supplemented during later years. Congress asserted its authority to legislate under several different parts of the United States Constitution, principally its power to regulate interstate commerce under Article One (section 8), its duty to guarantee all citizens equal protection of the laws under the Fourteenth Amendment, and its duty to protect voting rights under the Fifteenth Amendment.
