Fogerty V. Fantasy, Inc.
''Fogerty v. Fantasy, Inc.'', 510 U.S. 517 (1994), was a United States Supreme Court case that addressed the standards governing awards of attorneys' fees in copyright cases. The Copyright Act of 1976 authorizes, but does not require, the court to award attorneys' fees to "the prevailing party" in a copyright action. In ''Fogerty'', the Court held that such attorneys'-fees awards are discretionary, and that the same standards should be applied in the case of a prevailing plaintiff and a prevailing defendant. Facts John Fogerty was the lead singer of the popular rock group Creedence Clearwater Revival. In 1970, while part of the group, he wrote the song "Run Through the Jungle." Fantasy Records, the record label to which Creedence Clearwater Revival was signed, eventually acquired the exclusive publishing rights to the song. John Fogerty
John Cameron Fogerty (born May 28, 1945) is an American singer, songwriter and guitarist. Together with Doug Clifford, Stu Cook, and his brother Tom Fogerty Thomas Richard Fogerty (November 9, 1941 – September 6, 1990) was an American musician, best known as the rhythm guitarist for Creedence Clearwater Revival. He was posthumously inducted into the Rock and Roll Hall of Fame in 1993. Biography ..., he founded the band Creedence Clearwater Revival (CCR), for which he was the lead singer, lead guitarist, and principal songwriter. CCR had nine top-10 singles and eight gold albums between 1968 and 1972, and was inducted into the Rock and Roll Hall of Fame in 1993. Since CCR parted ways in 1972, Fogerty has had a successful solo career, which continues. He was listed on ''Rolling Stone'' magazine's list of 100 Greatest Songwriters (at No. 40) and the list of 100 Greatest Singers (at No. 72).
