The Judiciary of the Czech Republic is set out in the Constitution, which defines courts as independent institutions within the constitutional framework of checks and balances. The whole of chapter four of the Constitution of the Czech Republic is dedicated to defining the role of judicial power in the Czech Republic. It states the main function of courts of law is the protection of rights in a manner defined by legislation, and gives them sole responsibility for determining guilt and administering penalties for criminal offences. Following elections in October 2021, President Miloš Zeman asked Petr Fiala, as the leader of the Spolu alliance, to form a new government. Petr Fiala (; born 1 September 1964) is a Czech politician and political scientist who has been the prime minister of the Czech Republic since December 2021 and leader of the Civic Democratic Party (Czech Republic), Civic Democratic Party (ODS) since 2014. He previously served as the Ministry of Education, Youth and Sports (Czech Republic), Minister of Education, Youth and Sports from 2012 to 2013.
