Black Land Loss In The United States
Black land loss in the United States refers to the loss of land ownership and Property rights, rights by Black Americans, Black people residing or farming in the United States. In 1862, the United States government passed the Homestead Acts, Homestead Act. This Act gave certain Americans seeking farmland the right to apply for ownership of Federal lands, government land or the American frontier, public domain. This newly acquired farmland was typically called a Homestead (buildings), homestead. In all, more than of public land, or nearly 10 percent of the total area of the United States was given away free to 1.6 million homesteaders. However, until the United States abolished slavery in 1865 and the passage of the Fourteenth Amendment to the United States Constitution, 14th amendment in 1868, enslaved and free Blacks could not benefit from these acts. In common law systems, land tenure, from the French verb "tenir" means "to hold", is the legal regime in which land owned by an individual is possessed by someone else who is said to "hold" the land, based on an agreement between both individuals. It determines who can use land, for how long and under what conditions. Tenure may be based both on official laws and policies, and on informal local customs (insofar higher law does allow that). In other words, land tenure implies a system according to which land is held by an individual or the actual tiller of the land but this person does not have legal ownership.
