Cheque fraud (Commonwealth English), or check fraud (American English), refers to a category of criminal acts that involve making the unlawful use of cheques in order to illegally acquire or borrow funds that do not exist within the account balance or account-holder's legal ownership. Most methods involve taking advantage of the ''float'' (the time between the negotiation of the cheque and its clearance at the cheque writer's financial institution) to draw out these funds. Specific kinds of cheque fraud include cheque kiting, where funds are deposited before the end of the float period to cover the fraud, and paper hanging, where the float offers the opportunity to write fraudulent cheques but the account is never replenished. Check Kiting
Check kiting or cheque kiting (see spelling differences) is a form of check fraud, involving taking advantage of the float to make use of non-existent funds in a checking or other bank account. In this way, instead of being used as a negotiable instrument, checks are misused as a form of unauthorized credit. Kiting is commonly defined as intentionally writing a check for a value greater than the account balance from an account in one bank, then writing a check from another account in another bank, also with non-sufficient funds, with the second check serving to cover the non-existent funds from the first account. The purpose of check kiting is to falsely inflate the balance of a checking account in order to allow written checks to clear that would otherwise bounce. Qchex
Qchex was a website that allowed people to create and send checks drawn on any bank so long as they provided the ABA routing transit number and account number and a valid email address. The "Qchex" could then be e-mailed and printed out by the recipients. On September 25, 2006, United States District Judge William Q. Hayes, responding to a Federal Trade Commission lawsuit alleging that Qchex's practice of e-mailing personal checks without verifying the identity of the check-writers resulted in widespread fraud, ordered the practice halted. The FTC said it had received over 600 complaints from consumers who say the practice was used to fraudulently withdraw money from their accounts, including using federal agencies, like the FTC itself. Qchex's website itself advised that people register with Qchex to ensure that "no one else can set up or access your account numbers on the Qchex system." House Banking Scandal
The House banking scandal broke in early 1992, when it was revealed that the US House of Representatives allowed its members to overdraw their House checking accounts without the risk of being penalized by the House bank, which was actually a clearinghouse. ChexSystems is a check verification service and consumer reporting agency owned by the eFunds subsidiary of Fidelity National Information Services. It provides information about the use of deposit accounts by consumers. History In 1991, the agency was owned by Deluxe Corporation, and it was part of the spin-off from Deluxe that formed eFunds in 1999. Fidelity National Information Services acquired eFunds in 2007. The number of "bank and thrift branches" served in 1991 was 59,000. Bad Check Restitution Program
A bad check restitution program (BCRP) is a program in the United States that works to retrieve funds from bad check writers in order to repay moneys owed to the recipients of the checks. In other words, these are debt collection operations. Many of these programs are operated by private companies that add fees that may exceed $200, regardless of the amount of the check. They call these operations "bad check enforcement," or "bad check restitution," or "bad check diversion." Sometime, these programs are actually run in house by real prosecutors. The private companies send check writers letters which state basically, that to avoid being prosecuted, the check writer may enroll in an expensive diversion program. In most instances, the prosecution threats are false and made only to coerce payment of high fees.
