Bills Of Impeachment
An article of impeachment is a documented statement which specifies the charges to be tried in an impeachment trial as a basis for removing an officeholder. Articles of impeachment are an aspect of impeachment processes of many governments that utilize a bifurcated (two-part) impeachment process that sees a vote to "impeach" followed by an impeachment trial on whether to remove an officer. In an impeachment trial, an article of impeachment serves the same role that an indictment would in a criminal trial. Articles of impeachment are adopted prior to an impeachment trial by the legislative body with authority to invoke the impeachment that triggers the trial. In the trial, the accused party generally attempts to counter the elements of the article(s) of impeachment through arguments. United States Federal government In the United States federal government impeachments, the articles of impeachment are adopted by the United States House of Representatives. After the articles are ...

Impeachment Trial
An impeachment trial is a trial that functions as a component of an impeachment. Several governments utilize impeachment trials as a part of their processes for impeachment, but differ as to when in the impeachment process trials take place and how such trials are held. Trial as an earlier stage of an impeachment process In some countries, the term "impeachment" refers to the ultimate removal of an officeholder. In some such countries, a trial process is a component of the process related to impeachment, and occurs prior to an "impeachment" vote. An example of a government where this is the case is Brazil. Trial as the final stage of a bifurcated impeachment process Several other governments use a bifurcated (two-stage) process in which a vote to "impeach" triggers a subsequent trial in which the "impeached" individual is tried to determine whether they should be removed from office. In the United States, impeachment trials are held by both the federal and nearly all state gover ...

Indictment
An indictment ( ) is a formal accusation that a legal person, person has committed a crime. In jurisdictions that use the concept of felony, felonies, the most serious criminal offence is a felony; jurisdictions that do not use the felonies concept often use that of an indictable offence, an offence that requires an indictment. Australia Section 80 of the Constitution of Australia provides that "the trial on indictment of any offence against any law of the Commonwealth shall be by jury". The High Court of Australia has consistently used a narrow interpretation of this clause, allowing the Parliament of Australia to define which offences proceed on indictment rather than conferring a universal right to a jury trial. Section 4G of the ''Crimes Act 1914'' provides that "offences against a law of the Commonwealth punishable by imprisonment for a period exceeding 12 months are indictable offences, unless the contrary intention appears". Canada A direct indictment is one in which the ca ...

Criminal Trial
Criminal procedure is the adjudication process of the criminal law. While criminal procedure differs dramatically by jurisdiction, the process generally begins with a formal criminal charge with the person on trial either being free on bail or incarcerated, and results in the conviction or acquittal of the defendant. Criminal procedure can be either in form of inquisitorial or adversarial criminal procedure. Basic rights Currently, in many countries with a democratic system and the rule of law, criminal procedure puts the burden of proof on the prosecution – that is, it is up to the prosecution to prove that the defendant is guilty beyond any reasonable doubt, as opposed to having the defense prove that they are innocent, and any doubt is resolved in favor of the defendant. This provision, known as the presumption of innocence, is required, for example, in the 46 countries that are members of the Council of Europe, under Article 6 of the European Convention on Human R ...

Impeachment Inquiry In The United States
In the United States, an impeachment inquiry (also known as an impeachment investigation) is an investigation or inquiry which usually occurs before a potential impeachment vote. Federal An impeachment inquiry is not a required step in United States federal impeachment, as the Constitution of the United States does not require the United States House of Representatives (which it empowers to impeach many federal officeholders) to exercise its powers of impeachment in any specific manner. It is permissible for articles of impeachment to be adopted without any formal inquiry first occurring. Nevertheless, impeachment inquiries have been used as a step in many federal impeachment efforts, with around 90 impeachment-related inquiries having been initiated by the House of Representatives since 1789. No individual had been impeached by the United States House of Representatives without a preceding inquiry stage until the second impeachment of Donald Trump in 2021. Launching of a f ...

Markup (legislation)
Markup (or mark-up) is the process by which a U.S. congressional committee or state legislative session debates, amends, and rewrites proposed legislation. In the House of Representatives The process of marking up bills and resolutions in committees of the House of Representatives generally resembles, but does not perfectly replicate, the process of amending measures on the House floor. At the beginning of a markup, committee members often make opening statements, usually not exceeding five minutes apiece. The first reading of the text of the bill to be marked up can be waived, either by unanimous consent or by adopting a non-debatable motion. The bill then is read for amendment, one section at a time, with committee members offering their amendments to each section after it is read but before the next section is read. By unanimous consent only, the committee may agree to dispense with the reading of each section, or to consider a bill for amendment by titles or chapters instea ...

Tribal Sovereignty In The United States
Tribal sovereignty in the United States is the concept of the inherent authority of tribe (Native American), indigenous tribes to govern themselves within the borders of the United States. Originally, the Federal government of the United States, U.S. federal government recognized American Indian tribes as independent nations, and came to policy agreements with them via Treaty, treaties. As the U.S. accelerated its Westward Expansion, westward expansion, internal political pressure grew for "Indian removal", but the pace of treaty-making grew nevertheless. The American Civil War, Civil War forged the U.S. into a more centralized and nationalistic country, fueling a "full bore assault on tribal culture and institutions", and pressure for Native Americans to assimilate. In the Indian Appropriations Act#1871 Act, Indian Appropriations Act of 1871, Congress prohibited any future treaties. This move was steadfastly opposed by Native Americans. Currently, the U.S. recognizes tr ...
