Wiwa Family Lawsuits Against Royal Dutch Shell
The Wiwa- family lawsuits against Royal Dutch Shell were three separate lawsuits brought in 1996 by the family of Ken Saro-Wiwa against Royal Dutch Shell, its subsidiary Shell Nigeria and the subsidiary's CEO Brian Anderson. Charges included human rights abuses against the Ogoni people in the Niger Delta, summary execution, torture, arbitrary arrest, and wrongful death. After 12 years of Shell petitioning the court not to hear the cases, they were heard 26 May 2009. On June 8, 2009, Shell settled out-of-court with the Saro-Wiwa family for $15.5 million. Ken Saro-Wiwa
Kenule Beeson "Ken" Saro-Wiwa (10 October 1941 – 10 November 1995) was a Nigerian writer, television producer, and environmental activist. Ken Saro-Wiwa was a member of the Ogoni people, an ethnic minority in Nigeria whose homeland, Ogoniland, in the Niger Delta, has been targeted for crude oil extraction since the 1950s and has suffered extreme environmental damage from decades of indiscriminate petroleum waste dumping. Initially as a spokesperson, and then as the president, of the Movement for the Survival of the Ogoni People (MOSOP), Saro-Wiwa led a nonviolent campaign against environmental degradation of the land and waters of Ogoniland by the operations of the multinational petroleum industry, especially the Royal Dutch Shell company. Torture Victim Protection Act Of 1992
The Torture Victim Protection Act of 1991 (TVPA; ) is a statute that allows for the filing of civil suits in the United States against individuals who, acting in an official capacity for any foreign nation, committed torture and/or extrajudicial killing. The statute requires a plaintiff to show exhaustion of local remedies in the location of the crime, to the extent that such remedies are "adequate and available." Plaintiffs may be U.S. citizens or non-U.S. citizens. Although the Act was not passed until early 1992, it was introduced the previous year, and the official name of the Act is the "Torture Victim Protection Act of 1991." In common law, assault is the tort of acting intentionally, that is with either general or specific intent, causing the reasonable apprehension of an immediate harmful or offensive contact. Assault requires intent, it is considered an intentional tort, as opposed to a tort of negligence. Actual ability to carry out the apprehended contact is not necessary.
