WITSEC
The United States Federal Witness Protection Program (WPP), also known as the Witness Security Program or WITSEC, is a witness protection program codified through 18 U.S. Code § 3521 and administered by the United States Department of Justice and operated by the United States Marshals Service that is designed to protect threatened witnesses before, during, and after a trial. A handful of states – California, Connecticut, Illinois, New York, and Texas – and Washington, D.C., have their own witness protection programs for crimes not covered by the federal program. The state-run programs provide less extensive protections than the federal program, in part because state governments lack the ability to issue federal documents, such as social security cards, verifying the new identity of protected witnesses. History The WITSEC program was formally established under Title V of the Organized Crime Control Act of 1970, which in turn sets out the manner in which the United States ... Organized Crime Control Act
The Organized Crime Control Act of 1970 (, October 15, 1970), was an Act of Congress sponsored by Democratic Senator John L. McClellan and signed into law by U.S. President Richard Nixon. The Act was the product of two sets of hearings in the Senate, the Select Committee on Improper Activities in Labor and Management hearings of 1957-1959 and the McClellan hearings of 1962-1964. The Act prohibits the creation or management of a gambling organization involving five or more people if it has been in business more than 30 days or accumulates $2,000 in gross revenue in a single day. It also gave grand juries new powers, permitted detention of unmanageable witnesses, and gave the U.S. Attorney General authorization to protect witnesses, both state and federal, and their families. This last measure helped lead to the creation of WITSEC, an acronym for witness security. Part of the Act created the Racketeer Influenced and Corrupt Organizations Act The Racketeer Influenced an ... A Protected Witness Guarded By U
A, or a, is the first letter and the first vowel of the Latin alphabet, used in the modern English alphabet, the alphabets of other western European languages and others worldwide. Its name in English is ''a'' (pronounced ), plural ''aes''. It is similar in shape to the Ancient Greek letter alpha, from which it derives. The uppercase version consists of the two slanting sides of a triangle, crossed in the middle by a horizontal bar. The lowercase version can be written in two forms: the double-storey a and single-storey ɑ. The latter is commonly used in handwriting and fonts based on it, especially fonts intended to be read by children, and is also found in italic type. In English grammar, " a", and its variant " an", are indefinite articles. History The earliest certain ancestor of "A" is aleph (also written 'aleph), the first letter of the Phoenician alphabet, which consisted entirely of consonants (for that reason, it is also called an abjad to distinguish it fro ... Witness Protection
Witness protection is security provided to a threatened person providing testimonial evidence to the justice system, including defendants and other clients, before, during, and after a trial, usually by police. While a witness may only require protection until the conclusion of a trial, some witnesses are provided with a new identity and may live out the rest of their lives under government protection. Witness protection is usually required in trials against organized crime, where law enforcement sees a risk for witnesses to be intimidated by colleagues of defendants. It is also used at war crime, espionage and national security issues trials. Witness protection by country Not all countries have formal witness protection programs; instead, local police may implement informal protection as the need arises in specific cases. Canada Canada's Witness Protection Program Act received royal assent on June 20, 1996. The program is run by the Royal Canadian Mounted Police (RCMP), wi ... Witness Tampering
Witness tampering is the act of attempting to improperly influence, alter or prevent the testimony of witnesses within criminal or civil proceedings. Witness tampering and reprisals against witnesses in organized crime cases have been a difficulty faced by prosecutors; witness protection programs were one response to this problem. United States In the United States, the federal crime of witness tampering is defined by statute at , which is entitled "tampering with a witness, victim, or an informant." The statute is broad; the '' Justice Manual'' notes that it "proscribes conduct intended to illegitimately affect the presentation of evidence in Federal proceedings or the communication of information to Federal law enforcement officers" and applies to tampering with witnesses in "proceedings before Congress, executive departments, and administrative agencies, and to civil and criminal judicial proceedings, including grand jury proceedings." Witness Immunity
Witness immunity from prosecution occurs when a prosecutor grants immunity to a witness in exchange for testimony or production of other evidence. In the United States, the prosecution may grant immunity in one of two forms. Transactional immunity, colloquially known as "blanket" or "total" immunity, completely protects the witness from future prosecution for crimes related to his or her testimony. Use and derivative use immunity prevents the prosecution only from using the witness's own testimony or any evidence derived from the testimony against the witness. However, if the prosecutor acquires evidence substantiating the crime independently of the witness's testimony, the witness may then be prosecuted. Prosecutors at the state level may offer a witness either transactional or use and derivative use immunity, but at the federal level, use and derivative use immunity is much more common. In the United States, Congress can also grant criminal immunity (at the Federal level) to w ... [...More Info...]       [...Related Items...]     OR:     [Wikipedia]   [Google]   [Baidu]   |
