Tribunals (Scotland) Act 2014
The Tribunals (Scotland) Act 2014 is an Act of the Scottish Parliament passed in October 2014 to improve access to the civil justice system and while making the Court of Session a place for the more complex cases. History The Bill was passed by the Scottish Parliament on 11 March 2014 and received Royal Assent on 15 April 2014. Provisions The Act established the First-tier Tribunal for Scotland and the Upper Tribunal for Scotland, replacing a number of separate tribunals. It provides for the First-tier Tribunal to be organised into a number of chambers, according to subject-matter and other relevant factors. Scotland (, ) is a country that is part of the United Kingdom. Act Of The Scottish Parliament
An Act of the Scottish Parliament ( gd, Achd Pàrlamaid na h-Alba) is primary legislation made by the Scottish Parliament. The power to create Acts was conferred to the Parliament by section 28 of the Scotland Act 1998 following the successful 1997 referendum on devolution. Prior to the establishment of the Parliament under the 1998 Act, all post-union laws specific to Scotland were passed at the Westminster Parliament. Although the Westminster Parliament has retained the ability to legislate for Scotland, by convention it does not do so without the consent of the Scottish Parliament. Since the passing of the 1998 Act, the Westminster Parliament has passed five public general acts that apply only to Scotland. A draft Act is known as a Bill. Court Of Session
The Court of Session is the supreme civil court of Scotland and constitutes part of the College of Justice; the supreme criminal court of Scotland is the High Court of Justiciary. The Court of Session sits in Parliament House in Edinburgh and is both a trial court and a court of appeal. Decisions of the court can be appealed to the Supreme Court of the United Kingdom, with the permission of either the Inner House or the Supreme Court. The Court of Session and the local sheriff courts of Scotland have concurrent jurisdiction for all cases with a monetary value in excess of ; the plaintiff is given first choice of court. However, the majority of complex, important, or high value cases are brought in the Court of Session. The Scottish Parliament ( gd, Pàrlamaid na h-Alba ; sco, Scots Pairlament) is the devolved, unicameral legislature of Scotland. Located in the Holyrood area of the capital city, Edinburgh, it is frequently referred to by the metonym Holyrood. The First-tier Tribunal for Scotland (FtTfS) is a first-instance general tribunal in Scotland. It was created by the Tribunals (Scotland) Act 2014, which aimed to create a simplified structure for tribunals in Scotland, amalgamating the functions of several tribunals into one. The Lord President of the Court of Session, as head of the judiciary in Scotland, is responsible for the First-Tier Tribunal for Scotland. Some of the Lord President's functions in relation to tribunals have been delegated to the President of the Scottish Tribunals, currently Lady Wise. It is administered by the Scottish Courts and Tribunals Service. It is administered by the Scottish Courts and Tribunals Service. Jurisdiction The Upper Tribunal for Scotland hears appeals from the First-tier Tribunal for Scotland. The Lord President of the Court of Session and Lord Justice General is the most senior judge in Scotland, the head of the judiciary, and the presiding judge of the College of Justice, the Court of Session, and the High Court of Justiciary. The Lord President holds the title of Lord Justice General of Scotland and the head of the High Court of Justiciary ''ex officio'', as the two offices were combined in 1836.
