In some instances, a legal case may occur between parties that are not in opposition, but require a legal ruling to formally establish some legal fact, such as a divorce. Judge
A judge is a person who presides over court proceedings, either alone or as a part of a panel of judges. A judge hears all the witnesses and any other evidence presented by the barristers or solicitors of the case, assesses the credibility and arguments of the parties, and then issues a ruling in the case based on their interpretation of the law and their own personal judgment. A judge is expected to conduct the trial impartially and, typically, in an open court. The powers, functions, method of appointment, discipline, and training of judges vary widely across different jurisdictions. In some jurisdictions, the judge's powers may be shared with a jury. In inquisitorial systems of criminal investigation, a judge might also be an examining magistrate. The presiding judge ensures that all court proceedings are lawful and orderly. Mediation
Mediation is a structured, interactive process where an impartial third party neutral assists disputing parties in resolving conflict through the use of specialized communication and negotiation techniques. All participants in mediation are encouraged to actively participate in the process. Mediation is a "party-centered" process in that it is focused primarily upon the needs, rights, and interests of the parties. The mediator uses a wide variety of techniques to guide the process in a constructive direction and to help the parties find their optimal solution. A mediator is facilitative in that she/he manages the interaction between parties and facilitates open communication. Mediation is also evaluative in that the mediator analyzes issues and relevant norms ("reality-testing"), while refraining from providing prescriptive advice to the parties (e.g., "You should do..."). Mediation, as used in law, is a form of alternative dispute resolution resolving disputes between two o ...

Elder (administrative Title)
The term Elder, or its equivalent in another language, is used in several countries and organizations to indicate a position of authority. This usage is usually derived from the notion that the oldest members of any given group are the wisest, and are thus the most qualified to rule, provide counsel or serve the said group in some other capacity. Elder systems Elder is a role played in the organised community that is most common in tribal subsistence cultures, ''Elderhood'' being the condition or quality of being an elder. It is essentially the state of being in the latter portion of one's life and being looked to for leadership of either a passive or active nature by your peers and\or subordinates due almost exclusively to this fact. Sometimes it involves a ceremonial investiture of some kind, and other times it does not. Sometimes it involves a definite chronological milestone which must be surpassed, while at other times the required age is simply relative to the ages of all of ...

Sharia
Sharia (; ar, شريعة, sharīʿa ) is a body of religious law that forms a part of the Islamic tradition. It is derived from the religious precepts of Islam and is based on the sacred scriptures of Islam, particularly the Quran and the Hadith. In Arabic, the term ''sharīʿah'' refers to God's immutable divine law and is contrasted with ''fiqh'', which refers to its human scholarly interpretations. In the historical course, fiqh sects have emerged that reflect the preferences of certain societies and state administrations on behalf of people who are interested in the theoretical (method) and practical application (Ahkam / fatwa) studies of laws and rules, but sharia has never been a valid legal system on its own. It has been used together with " customary (Urf) law" since Omar or the Umayyads. It may also be wrong to think that the Sharia, as a religious argument or belief, is entirely within or related to Allah's commands and prohibitions. Several non-graded crimes are ...

Legal System
The contemporary national legal systems are generally based on one of four basic systems: civil law, common law, statutory law, religious law or combinations of these. However, the legal system of each country is shaped by its unique history and so incorporates individual variations. The science that studies law at the level of legal systems is called comparative law. Both ''civil'' (also known as ''Roman'') and ''common'' law systems can be considered the most widespread in the world: civil law because it is the most widespread by landmass and by population overall, and common law because it is employed by the greatest number of people compared to any single civil law system. Civil law The source of law that is recognized as authoritative is codifications in a constitution or statute passed by legislature, to amend a code. While the concept of codification dates back to the Code of Hammurabi in Babylon ca. 1790 BC, civil law systems derive from the Roman Empire and, more p ...

Islamic Courts Union
The Islamic Courts Union ( so, Midowga Maxkamadaha Islaamiga) was a legal and political organization formed to address the lawlessness that had been gripping Somalia since the fall of the Siad Barre regime in 1991 during the Somali Civil War. The Islamic Courts Union was embraced by a plurality of Somalis, as Islam was viewed as one of the last credible institutions left in the wake of the collapse of the state. The courts were able to quickly gain the trust of war weary Somalis, as they had emerged at a grassroots level and claimed to rule under the neutrality of Islam, which was viewed as an attractive alternative to the country rife with heightened clan tensions. The union was a diffuse organization, with rivaling leaders sending conflicting messages about the group's goals. Some members had national political ambitions, while others wanted to focus on resolving local disputes and bringing people closer to Islam. In the summer of 2006, the ICU would expel an alliance of Som ...
