Texas Third Court Of Appeals
The Texas Courts of Appeals are part of the Texas judicial system. In Texas, all cases appealed from district and county courts, criminal and civil, go to one of the fourteen intermediate courts of appeals, with one exception: death penalty cases. The latter are taken directly to the Texas Court of Criminal Appeals, the court of last resort for criminal matters in the State of Texas. The highest court for civil and juvenile matters is the Texas Supreme Court. While the Supreme Court (SCOTX) and the Court of Criminal Appeals (CCA) each have nine members per the Texas Constitution, the sizes of the intermediate courts of appeals are set by statute and vary greatly, depending on historical case filings and so that the justices on each court can timely adjudicate the volume of cases regularly before them. The total number of intermediate appellate court seats currently stands at 80, ranging from three (Texarkana, El Paso, Waco, Eastland, and Tyler), four (Amarillo and Beaumont), six ... Texas Judicial System
The structure of the judiciary of Texas is laid out in Article 5 of the Constitution of Texas and is further defined by statute, in particular the Texas Government Code and Texas Probate Code. The structure is complex, featuring many layers of courts, numerous instances of overlapping jurisdiction (in terms of territory), several differences between counties, as well as an unusual bifurcated appellate system at the top level found in only one other state: Oklahoma. Municipal Courts are the most active courts, with County Courts and District Courts handling most other cases and often sharing the same courthouse. Administration is the responsibility of the Supreme Court of Texas, which is aided by the Texas Office of Court Administration, Texas Judicial Council and the State Bar of Texas, which it oversees. The State Bar of Texas (SBOT) is a mandatory bar, rather than merely a voluntary association of lawyers (such as the ABA or local bar associations). In order to practice law in Te ... Texas Law
The law of Texas is derived from the ''Constitution of Texas'' and consists of several levels, including constitutional, statutory, and regulatory law, as well as case law and local laws and regulations. Sources The Constitution of Texas is the foremost source of state law. Legislation is enacted by the Texas Legislature, published in the '' General and Special Laws'', and codified in the ''Texas Statutes''. State agencies publish regulations (sometimes called administrative law) in the '' Texas Register'', which are in turn codified in the '' Texas Administrative Code''. The Texas legal system is based on common law, which is interpreted by case law through the decisions of the Supreme Court, the Court of Criminal Appeals, and the Courts of Appeals, which are published in the ''Texas Cases'' and ''South Western Reporter''. Counties and municipal governments may also promulgate local ordinances. Constitution The Constitution of Texas is the foundation of the government of Texa ... Capital Punishment
Capital punishment, also known as the death penalty, is the state-sanctioned practice of deliberately killing a person as a punishment for an actual or supposed crime, usually following an authorized, rule-governed process to conclude that the person is responsible for violating norms that warrant said punishment. The sentence ordering that an offender is to be punished in such a manner is known as a death sentence, and the act of carrying out the sentence is known as an execution. A prisoner who has been sentenced to death and awaits execution is ''condemned'' and is commonly referred to as being "on death row". Crimes that are punishable by death are known as ''capital crimes'', ''capital offences'', or ''capital felonies'', and vary depending on the jurisdiction, but commonly include serious crimes against the person, such as murder, mass murder, aggravated cases of rape (often including child sexual abuse), terrorism, aircraft hijacking, war crimes, crimes against h ... Mandamus
(; ) is a judicial remedy in the form of an order from a court to any government, subordinate court, corporation, or public authority, to do (or forbear from doing) some specific act which that body is obliged under law to do (or refrain from doing), and which is in the nature of public duty, and in certain cases one of a statutory duty. It cannot be issued to compel an authority to do something against statutory provision. For example, it cannot be used to force a lower court to take a specific action on applications that have been made, but if the court refuses to rule one way or the other then a mandamus can be used to order the court to rule on the applications. Mandamus may be a command to do an administrative action or not to take a particular action, and it is supplemented by legal rights. In the American legal system it must be a judicially enforceable and legally protected right before one suffering a grievance can ask for a mandamus. A person can be said to be aggrie ...
