''Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel)'' is a case brought before the International Court of Justice (ICJ) on 29 December 2023 by South Africa regarding Israel's conduct in the Gaza Strip as part of the Israel–Hamas war. South Africa alleged that Israel had committed and was committing genocide against Palestinians in the Gaza Strip, contravening the Genocide Convention, including what South Africa described as Israel's 75-year apartheid, 56-year occupation, and 16-year blockade of the Strip. South Africa requested that the ICJ indicate provisional measures including the immediate suspension of its military operations in and against Gaza. The South African legal team includes John Dugard, Adila Hassim, Tembeka Ngcukaitobi, Blinne Ní Ghrálaigh and Vaughan Lowe. It appointed Dikgang Moseneke as ''ad hoc'' judge. Israel's Foreign Ministry characterized South Africa's charges ...

International Court Of Justice
The International Court of Justice (ICJ; french: Cour internationale de justice, links=no; ), sometimes known as the World Court, is one of the six principal organs of the United Nations (UN). It settles disputes between states in accordance with international law and gives advisory opinions on international legal issues. The ICJ is the only international court that adjudicates general disputes between countries, with its rulings and opinions serving as primary sources of international law. The ICJ is the successor of the Permanent Court of International Justice (PCIJ), which was established in 1920 by the League of Nations. After the Second World War, both the league and the PCIJ were replaced by the United Nations and ICJ, respectively. The Statute of the ICJ, which sets forth its purpose and structure, draws heavily from that of its predecessor, whose decisions remain valid. All member states of the UN are party to the ICJ Statute and may initiate contentious cases; ho ...

Israeli-occupied Territories
Israeli-occupied territories are the lands that were captured and occupied by Israel during the Six-Day War of 1967. While the term is currently applied to the Palestinian territories and the Golan Heights, it has also been used to refer to areas that were formerly occupied by Israel, namely the Sinai Peninsula and southern Lebanon. Prior to Israel's victory in the Six-Day War, governance of the Palestinian territories was split between Egypt and Jordan, with the former having occupied the Gaza Strip and the latter having annexed the West Bank; the Sinai Peninsula and the Golan Heights were under the sovereignty of Egypt and Syria, respectively. The first conjoined usage of the terms "occupied" and "territories" with regard to Israel was in United Nations Security Council Resolution 242, which was drafted in the aftermath of the Six-Day War and called for: "the establishment of a just and lasting peace in the Middle East" to be achieved by "the application of both the followi ...

Israel And Apartheid
The Israeli government is accused of committing the crime of apartheid under the 2002 Rome Statute of the International Criminal Court, charges the state and its supporters deny. In December 2019, the Committee on the Elimination of Racial Discrimination determined that it has jurisdiction over the complaint the State of Palestine has filed against Israel for breaches of its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and would commence a review of the Palestinian complaint that Israel's policies in the West Bank amount to apartheid. Soon after this, two Israeli human rights NGOs, Yesh Din (July 2020), and B'Tselem (January 2021) issued separate reports that concluded, in the latter's words, that "the bar for labeling the Israeli regime as apartheid has been met."Michael SfardIsraeli progressives have started to talk about ‘apartheid’The Guardian 3 June 2021. Palestinian Genocide Accusation
The State of Israel has been accused of inciting or carrying out genocide against the Palestinians in the Israeli-Palestinian conflict. This accusation is linked by supporters to the conceptualization of Israel as a settler colonial state. Those who take this stance say that Israel has committed genocide due to their anti-Palestinianism, Islamophobia, anti-Arab racism and the proposal to annex the West Bank. Supporters of this claim cite the Nakba, the Sabra and Shatila massacre, the blockade of the Gaza Strip, the 2014 Gaza War and the 2023 Israel–Hamas war. International law and genocide scholars accuse Israeli officials of using dehumanizing language. Israel, the United States, the Anti-Defamation League and other organizations, and some law and genocide scholars have rejected the assertion that Israel is engaging in genocide. While some scholars describe Palestinians as victims of genocide, others argue they are not victims of genocide, but rather of ethnic cleansing, ...

Allegations Of Genocide In The 2023 Israeli Attack On Gaza
The Israel, State of Israel has been accused of genocide against Palestinians in the Gaza Strip during the Israel–Hamas war. Various scholars, and the United Nations Special Rapporteur on the occupied Palestinian territories, United Nations Special Rapporteur Francesca Albanese, have cited statements by senior Israeli officials, which they argue demonstrate an "Genocidal intent, intent to destroy" the population of Gaza, a necessary condition for the legal threshold of genocide to be met. The government of South Africa has instituted proceedings, ''South Africa v. Israel (Genocide Convention), South Africa v. Israel'', against Israel at the International Court of Justice, alleging genocide. In an interim ruling, the International Court of Justice found Israel was operating under plausible intent to commit genocide and ordered Israel to observe its obligations under the Genocide Convention by taking all measures within its power to prevent the commission of acts of genocide, ...

Genocide Convention
The Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG), or the Genocide Convention, is an international treaty that criminalizes genocide and obligates state parties to pursue the enforcement of its prohibition. It was the first legal instrument to codify genocide as a crime, and the first human rights treaty unanimously adopted by the United Nations General Assembly, on 9 December 1948, during the third session of the United Nations General Assembly. The Convention entered into force on 12 January 1951 and has 152 state parties . The Genocide Convention was conceived largely in response to World War II, which saw atrocities such as the Holocaust that lacked an adequate description or legal definition. Polish-Jewish lawyer Raphael Lemkin, who had coined the term genocide in 1944 to describe Nazi policies in occupied Europe and the Armenian genocide, campaigned for its recognition as a crime under international law. This culminated in 1946 in a land ...
