Samuel M. Bay
Samuel M. Bay (June 1, 1810 – May 29, 1849) was an American lawyer who represented Dred Scott in the 1847 '' Scott v. Emerson'' case. He was known for his prosecution of Dedimus Buell Burr, who had put ground glass in his ill wife's food over time. He practiced law in Jefferson and St. Louis, Missouri. Bay served in the Missouri Legislature beginning in 1836 and was appointed as Missouri Attorney General from 1839 to 1845. His father and grandfather were attorneys and his uncle Dr. Joseph Lovell, was surgeon-general of the United States Army. He studied under Salmon P. Chase, who was later secretary of the treasury under President Abraham Lincoln, and chief justice of the Supreme Court. Early life Samuel Mansfield Bay was born in Hudson, New York in 1810. Hudson, New York
Hudson is a city and the county seat of Columbia County, New York, United States. As of the 2020 census, it had a population of 5,894. Located on the east side of the Hudson River and 120 miles from the Atlantic Ocean, it was named for the river and its explorer Henry Hudson. History The native Mahican people had occupied this territory for hundreds of years before Dutch colonists began to settle here in the 17th century, calling it "Claverack Landing". In 1662, some of the Dutch bought this area of land from the Mahican. It was originally part of the Town of Claverack. In 1783, the area was settled largely by Quaker New England whalers and merchants hailing primarily from the islands of Nantucket and Martha's Vineyard in Massachusetts, and Providence, Rhode Island, led by Thomas and Seth Jenkins. Freedom Suit
Freedom suits were lawsuits in the Thirteen Colonies and the United States filed by slaves against slaveholders to assert claims to freedom, often based on descent from a free maternal ancestor, or time held as a resident in a free state or territory. The right to petition for freedom descended from English common law and allowed people to challenge their enslavement or indenture. Petitioners challenged slavery both directly and indirectly, even if slaveholders generally viewed such petitions as a means to uphold rather than undermine slavery. Beginning with the colonies in North America, legislatures enacted slave laws that created a legal basis for "just subjection;" these were adopted or updated by the state and territorial legislatures that superseded them after the United States gained independence. Reading law was the method used in common law countries, particularly the United States, for people to prepare for and enter the legal profession before the advent of law schools. It consisted of an extended internship or apprenticeship under the tutelage or mentoring of an experienced lawyer. The practice largely died out in the early 20th century. A few U.S. states still permit people to become lawyers by reading law instead of attending law school, although the practice is rare.
