Rent Repayment Order
A Rent Repayment Order (RRO) is an order in the United Kingdom that allows a tenant or local authority to reclaim rent or housing benefit where a landlord rents out an unlicensed property such as a House in multiple occupation (HMO). Rent Repayment Orders are not obtained through the court's system but through a Residential Property Tribunal. Housing academic David Cowan writing in ''Housing Law and Policy'' cites the case ''Newham London Borough Council v Ring'' to demonstrate that a local authority can use a rent repayment order to reclaim housing benefit. Local authorities can only apply for a Rent Repayment Order where occupiers pay their rent with the assistance of housing benefit. Housing Benefit is a means-tested social security benefit in the United Kingdom that is intended to help meet housing costs for rented accommodation. It is the second biggest item in the Department for Work and Pensions' budget after the state pension, totalling £23.8 billion in 2013–14. The primary legislation governing Housing Benefit is the Social Security Contributions and Benefits Act 1992. Operationally, the governing regulations are statutory instruments arising from that Act. It is governed by one of two sets of regulations. A house in multiple occupation (HMO), or a house of multiple occupancy, is a British English term which refers to residential properties where ‘common areas’ exist and are shared by more than one household. Most HMOs have been subdivided from larger houses designed for and occupied by one family. The Housing Act 2004 (c 34) is an Act of the Parliament of the United Kingdom. It introduced Home Information Packs, which have since been abandoned. Protection From Eviction Act 1977
The Protection from Eviction Act 1977c 43 is an Act of Parliament of the United Kingdom protecting people renting accommodation from losing their homes without the involvement of a court. Contents The Act's aim is to protect tenants from being ejected from their homes by landlords, unless there has been a court order. Section 3 states that nobody can be forcibly evicted without a court order. The purpose of this section was to prevent aggressive landlords becoming violent. Section 3A states that there are a number of exclusions. These are primarily when a landlord actually resides in the same property as the tenant, or the accommodation falls within the definition of a hostel or hotel.
