Medically Indigent Adult
Medically Indigent Adults (MIAs) in the health care system of the United States are persons who do not have health insurance and who are not eligible for other health care such as Medicaid, Medicare, or private health insurance. This is a term that is used both medically and for the general public. According to data reported by The Henry J. Kaiser Family Foundation in 2017, 45% of non-elderly adults do not have medical insurance because of cost. Those who are "medically indigent earn too much to qualify for Medicaid but too little to purchase either health insurance or health care." Medically indigent people with significant illnesses face several barriers to health insurance. States like South Carolina came up with their own MIAP program to assist those who fall in the gaps. Government Help On March 23, 2010, the Affordable Care Act came into effect, which impacted the definition of medical indigence in the United States. The act is credited as benefiting thousands of Americans ...

Illegal Aliens
Illegal immigration is the migration of people into a country in violation of the immigration laws of that country or the continued residence without the legal right to live in that country. Illegal immigration tends to be financially upward, from poorer to richer countries. Illegal residence in another country creates the risk of detention, deportation, and/or other sanctions. Asylum seekers who are denied asylum may face impediment to expulsion if the home country refuses to receive the person or if new asylum evidence emerges after the decision. In some cases, these people are considered illegal aliens, and in others, they may receive a temporary residence permit, for example with reference to the principle of non-refoulement in the international Refugee Convention. The European Court of Human Rights, referring to the European Convention on Human Rights, has shown in a number of indicative judgments that there are enforcement barriers to expulsion to certain countries, f ...

Health Insurance
Health insurance or medical insurance (also known as medical aid in South Africa) is a type of insurance that covers the whole or a part of the risk of a person incurring medical expenses. As with other types of insurance, risk is shared among many individuals. By estimating the overall risk of health risk and health system expenses over the risk pool, an insurer can develop a routine finance structure, such as a monthly premium or payroll tax, to provide the money to pay for the health care benefits specified in the insurance agreement. The benefit is administered by a central organization, such as a government agency, private business, or not-for-profit entity. According to the Health Insurance Association of America, health insurance is defined as "coverage that provides for the payments of benefits as a result of sickness or injury. It includes insurance for losses from accident, medical expense, disability, or accidental death and dismemberment". Background A health i ...

Poor Person
A poor person is a legal status in many countries in the world that allows an individual to have fair court even if he/she does not have enough financial savings. If a judge believes that the accused person is without the financial resources to pay the costs of a court action or proceeding, he/she may apply for (IFP) status. It is a Latin term for "in the manner of a pauper," which describes a litigant who is excused by a court from paying filing fees and court costs because she cannot afford to do so. Before authorizing a person to proceed , courts typically require an affidavit that, among other things, discloses the person's assets and income. Although excused from paying court fees and costs, a litigant who is authorized to proceed still must pay other expenses, such as deposition transcription costs and witness fees. Disproportionate Share Hospital
The United States government provides funding to hospitals that treat indigent patients through the Disproportionate Share Hospital (DSH) programs, under which facilities are able to receive at least partial compensation. Although 3,109 hospitals receive this adjustment, Medicare DSH payments are highly concentrated. Ninety-three percent of total DSH payments go to large hospitals in urban areas, and teaching hospitals receive about 65 percent of all DSH payments. Additionally, because Medicaid eligibility and coverage vary widely across states, Medicare DSH payments are distributed unevenly across geographic areas: the Middle Atlantic, South Atlantic, and Pacific regions account for 60 percent of all DSH payments but only 46 percent of Medicare discharges. Patient Protection Affordable Care Act of 2010 The Patient Protection and Affordable Care Act (PPCA) aims to reduce: * Funding for the Medicaid DSH program by $17.1 billion between 2014 and 2020; * Aggregate Medicaid DSH allo ...

Municipal
A municipality is usually a single administrative division having corporate status and powers of self-government or jurisdiction as granted by national and regional laws to which it is subordinate. The term ''municipality'' may also mean the governing body of a given municipality. A municipality is a general-purpose administrative subdivision, as opposed to a special-purpose district. The term is derived from French and Latin . The English word ''municipality'' derives from the Latin social contract (derived from a word meaning "duty holders"), referring to the Latin communities that supplied Rome with troops in exchange for their own incorporation into the Roman state (granting Roman citizenship to the inhabitants) while permitting the communities to retain their own local governments (a limited autonomy). A municipality can be any political jurisdiction, from a sovereign state such as the Principality of Monaco, to a small village such as West Hampton Dunes, New York. The ...

County (United States)
In the United States, a county is an administrative or political subdivision of a state that consists of a geographic region with specific boundaries and usually some level of governmental authority. The term "county" is used in 48 states, while Louisiana and Alaska have functionally equivalent subdivisions called parishes and boroughs, respectively. The specific governmental powers of counties vary widely between the states, with many providing some level of services to civil townships, municipalities, and unincorporated areas. Certain municipalities are in multiple counties; New York City is uniquely partitioned into five counties, referred to at the city government level as boroughs. Some municipalities have consolidated with their county government to form consolidated city-counties, or have been legally separated from counties altogether to form independent cities. Conversely, those counties in Connecticut, Rhode Island, eight of Massachusetts's 14 counties, and Alaska ...

EMTALA
The Emergency Medical Treatment and Active Labor Act (EMTALA) is an act of the United States Congress, passed in 1986 as part of the Consolidated Omnibus Budget Reconciliation Act (COBRA). It requires hospital emergency departments that accept payments from Medicare to provide an appropriate ''medical screening examination'' (MSE) to anyone seeking treatment for a medical condition'','' regardless of citizenship, legal status, or ability to pay. Participating hospitals may not transfer or discharge patients needing emergency treatment except with the informed consent or stabilization of the patient or when their condition requires transfer to a hospital better equipped to administer the treatment. EMTALA applies to "participating hospitals." The statute defines participating hospitals as those that accept payment from the Department of Health and Human Services, Centers for Medicare and Medicaid Services (CMS) under the Medicare program. Because there are very few hospitals that ...

Affordable Care Act
The Affordable Care Act (ACA), formally known as the Patient Protection and Affordable Care Act and colloquially known as Obamacare, is a landmark U.S. federal statute enacted by the 111th United States Congress and signed into law by President Barack Obama on March 23, 2010. Together with the Health Care and Education Reconciliation Act of 2010 amendment, it represents the U.S. healthcare system's most significant regulatory overhaul and expansion of coverage since the enactment of Medicare and Medicaid in 1965. The ACA's major provisions came into force in 2014. By 2016, the uninsured share of the population had roughly halved, with estimates ranging from 20 to 24 million additional people covered. The law also enacted a host of delivery system reforms intended to constrain healthcare costs and improve quality. After it went into effect, increases in overall healthcare spending slowed, including premiums for employer-based insurance plans. The increased coverage was due, ...
