M V The Queen
''M v R'' or M v The Queen is an Australian legal case decided in the High Court. It is an important authority in the field of criminal law, for the circumstances in which it is permissible for a jury's guilty verdict to be overturned by a judge. The case involved an appeal against criminal conviction by a father, against allegations of sexual assault and rape by his daughter. His appeal was allowed by majority. Background M was convicted in the District Court in Sydney. The counts found against him were two of indecent assault, and three of sexual intercourse. Each was allegedly committed against the complainant; one of his biological daughters. The daughter was 13 years old at the time of the alleged offending. Brian Sully
Brian Thomas Sully (3 February 1936 – 6 March 2019) was an Australian judge and legal scholar. He served as a justice of the Supreme Court of New South Wales from 1989 to 2007. Sully was an adjunct professor of law at the Western Sydney University. He lectured in advocacy although he lectured in Criminal Procedure and Evidence in 2007. Sully donated his collection of legal books and judicial robes to the university, which are on display in the Faculty of Law in Campbelltown. Sully died on 6 March 2019. He was made a life member of the New South Wales Bar Association shortly before his death. Education Sully studied law at the University of Sydney graduating in 1959. Career Sully was admitted to practice as a solicitor in 1959. In 1962, Sully was called to the NSW Bar. Hymen
The hymen is a thin piece of mucosal tissue that surrounds or partially covers the external vaginal opening. It forms part of the vulva, or external genitalia, and is similar in structure to the vagina. In children, a common appearance of the hymen is crescent-shaped, although many shapes are possible. Mervyn Finlay
Mervyn David Finlay (17 June 1925 – 2 July 2014) was an Australian judge of the Supreme Court of New South Wales and Queen's Counsel. He was a WWII RAAF officer, represented Australia at rowing in the 1952 Summer Olympics and was a NSW state athletics champion. Early life and sporting career Born in Balmain, Sydney one of two children to solicitor Mervyn Finlay and his wife Marjorie (née Kirkwood), Finlay was educated at Sydney Grammar School. He was commissioned an RAAF Flying Officer in the closing stages of World War II. In 1948 he was the New South Wales state athletics champion at the 880yds event.
