Kiribati Court Of Appeal
The Kiribati Court of Appeal is the supreme court of Kiribati established according to the Constitution of Kiribati of 12 July 1979 (section 90). The Court sits in Betio, South Tarawa. Sometimes the superior court of Kiribati is also considered to be the High Court of Kiribati because they also share the same building and personal, and the Court of Appeal is a division of High Court, but the Court of Appeal has a superior role. It consists of at least 5 judges whom the Chief Justice of the High Court of Kiribati and 4 other judges named Justices of Appeal (JA), all of them appointed by the President of Kiribati. There is also a president of the Court, also appointed by the President of Kiribati in accordance to section 90 (3) of the constitution. The Constitution of Kiribati is the supreme law of Kiribati, which was implemented in 1979. The constitution was subsequently amended in the years 1995, 2016, and 2018. The constitution established the principles of the Bill of Rights and the protection of the Fundamental Rights and Freedoms of the individual. History In 1977, John Hilary Smith, British Governor of the Gilbert Islands, reunited a Constitutional Convention of 150 members. Kiribati's independence was granted by the United Kingdom as a result of the Kiribati Independence Order 1979 (UK). The Republic of Kiribati became an independent constitutional republic as a sovereign and democratic state, and the 41st member of the Commonwealth of Nations on 12 July 1979. Betio
Betio is the largest township of Kiribati's capital city, South Tarawa, and the country's main port. The settlement is located on a separate islet at the extreme southwest of the atoll. Betio Post Office opened on 5 April 1957 and closed in 1964. In 1967, the Marine Training Centre was created by Hamburg Süd. John Hilary Smith, governor of the Gilbert and Ellice Islands created the Betio Town Council in 1972. Since the 1970s, the islet has become a major centre of economic activity in Kiribati, and a causeway to Bairiki was constructed in the early 1980s, leading to an increase in human contact with the island. Due to changing currents resulting from the construction of the causeway, Bikeman Island, northeast of Betio, has been submerged since the early 1990s. South Tarawa
South Tarawa ( gil, Tarawa Teinainano) is the capital and hub of the Republic of Kiribati and home to more than half of Kiribati's population. The South Tarawa population centre consists of all the small islets from Betio in the west to Bonriki and Tanaea in the north-east, connected by the South Tarawa main road, with a population of 63,439 . The president of Kiribati ( gil, Beretitenti) is the head of state and head of government of Kiribati. Following a general election, by which citizens elect the members of the House of Assembly, members select from their midst "not less than 3 nor more than 4 candidates" for the presidency. Bill Hastings (judge)
William "Bill" Kenneth Hastings was New Zealand's tenth Chief Censor. He held the position from October 1999 to July 2010. He was Chairperson of the Immigration and Protection Tribunal from July 2010 until February 2013, and is currently a District Court Judge. He was the chair of the Broadcasting Standards Authority from October 2018 until August 2021. He was sworn in as the tenth Judge of the Court Martial of New Zealand on 20 July 2021. On 9 August 2021, Hastings was sworn in as Chief Justice of the Republic of Kiribati. Peter Blanchard
Sir Peter Blanchard (born 2 August 1942) is a former judge of the Supreme Court of New Zealand. Biography Blanchard was born in the Auckland suburb of Epsom on 2 August 1942, the son of Cyril and Zora Blanchard. His father served as a flying officer with the Royal New Zealand Air Force during World War II, and died during air operations over Germany on 26 May 1943. In 1968, Blanchard received a Master of Laws degree from the University of Auckland Law School. He was then awarded a Fulbright Scholarship and a Frank Knox Memorial Fellowship from Harvard Law School where he received a master's degree in law. He specialized in commercial, insolvency and property law as a partner at the Auckland law firms of Grierson Jackson & Partners (1968–1983) and Simpson Grierson (1983 to 1992). 2022 Kiribati Constitutional Crisis
A constitutional crisis began in Kiribati when the Cabinet of Kiribati suspended two of its Court Justices. High Court Judge David Lambourne was suspended in May 2022 while Chief Justice Bill Hastings was suspended on 30 June 2022, both over allegations of misconduct. A Court of Appeal ruling upheld an earlier ruling of Chief Justice Hastings that the government acted unconstitutionally in not permitting David Lambourne to resume his duties as a High Court judge, and overturned the subsequent attempted deportation of Lambourne. In response, the government suspended all judges from the Kiribati Court of Appeal on 6 September 2022. The government's actions prompted condemnations from legal agencies and law councils from Australia, New Zealand and the Commonwealth while two former Presidents of Kiribati called it unconstitutional.
