''Clarke v. OHSU'', 343 Or. 581, 175 P.3d 418 (2007), was a 2007 decision of the Oregon Supreme Court interpreting Oregon law on the potential tort liability of public employees. Background The plaintiff, Jordaan Michael Clarke, underwent successful heart surgery as an infant in 1998 at Oregon Health Sciences University (now Oregon Health and Science University, or OHSU) hospital, but suffered prolonged oxygen deprivation causing permanent and profound brain damage. After college and law school on the East Coast, he moved to Oregon where he worked in private practice before joining the Oregon Department of Justice. Martha Lee Walters (born October 23, 1950) is an American labor attorney and who served as the 43rd chief justice of Oregon from 2018 to 2022; she was a member of the court from 2006 to 2022. She became the first female justice on the state's highest court in three years when she was appointed in 2006 and the first female chief justice when she was elected by her fellow justices in 2018. Virginia Lynn Linder (born 1953) is an American judge from Oregon who served as the 99th justice of the Oregon Supreme Court from January 2007 until January 2016. The Oregon Court of Appeals is the state intermediate appellate court in the US state of Oregon. Part of the Oregon Judicial Department, it has thirteen judges and is located in Salem. Except for death penalty cases, which are reserved to the Oregon Supreme Court, and tax court cases, it has jurisdiction to hear all civil and criminal appeals from Oregon circuit courts, and to review actions of most state administrative agencies.
