John Payton (Arkansas Politician)
John A. Payton (December 27, 1946 – March 22, 2012) was an African-American civil rights attorney. In 2008, he was appointed the sixth president and director-counsel of the NAACP Legal Defense Fund serving in that post until his death. Prior to this, he was a partner at the law firm WilmerHale for 20 years. Payton was tapped to be the lead counsel for the University of Michigan in defending its law and undergraduate schools' use of race in their admissions processes. For more than six years, Payton handled the two high-profile cases in the trial court and in the court of appeals, and argued ''Gratz v. Sharon Pratt Dixon
Sharon Pratt (born January 30, 1944), formerly Sharon Pratt Dixon and Sharon Pratt Kelly, is an American attorney and politician who was the third mayor of the District of Columbia from 1991 to 1995, the first mayor born in the District of Columbia since Richard Wallach who took office in 1861 and the first woman in that position. Personal life Sharon Pratt was born to D.C. Superior Court judge Carlisle Edward Pratt and Mildred "Peggy" (Petticord) Pratt. Strict Scrutiny
In U.S. constitutional law, when a law infringes upon a fundamental constitutional right, the court may apply the strict scrutiny standard. Strict scrutiny holds the challenged law as presumptively invalid unless the government can demonstrate that the law or regulation is necessary to achieve a " compelling or overriding state interest". The government must also demonstrate that the law is "narrowly tailored" to achieve that compelling purpose, and that it uses the "least restrictive means" to achieve that purpose. Failure to meet this standard will result in striking the law as unconstitutional. The standard is the highest and most stringent standard of judicial review and is part of the levels of judicial scrutiny that courts use to determine whether a constitutional right or principle should give way to the government's interest against observance of the principle.
