In Re Himmel
''In re Himmel'', 125 Ill.2d 531, 533 N.E.2d 790 (Ill. 1988), was a case decided by the Supreme Court of Illinois that upheld the suspension of an attorney's license for failing to report misconduct by another attorney. Factual background Himmel, an attorney, agreed to represent the 18-year-old victim of a motorcycle accident to recover settlement money from her first attorney. The client had won a $23,000 settlement after the accident, but her first attorney had allegedly pocketed the money instead. The client asked Himmel not to report the first lawyer's misconduct to the Illinois Attorney Registration and Disciplinary Commission (IARDC) because she feared that it would hinder the recovery efforts. Over the course of 24 months, Himmel brokered an agreement where the first attorney promised to pay $75,000 if the client agreed not to prosecute. Supreme Court Of Illinois
The Supreme Court of Illinois is the state supreme court, the highest court of the State of Illinois. The court's authority is granted in Article VI of the current Illinois Constitution, which provides for seven justices elected from the five appellate judicial districts of the state: three justices from the First District (Cook County) and one from each of the other four districts. Duty To Report Misconduct
The duty to report misconduct is one of the ethical duties imposed on attorneys in the United States by the rules governing professional responsibility. With certain exceptions, an attorney who becomes aware that either a fellow attorney or a judge has committed an act in violation of the rules of ethical conduct must report that violation. Failure to do so subjects the attorney failing to make the report to discipline. The duty extends only to actual knowledge possessed by an attorney. An attorney who has a mere suspicion of misconduct is not required to report that suspicion, nor is the attorney required to conduct any sort of investigation to confirm or dispel that suspicion. Attorney–client privilege or lawyer–client privilege is the name given to the common law concept of legal professional privilege in the United States. Operation Greylord
Operation Greylord was an investigation conducted jointly by the Federal Bureau of Investigation, the IRS Criminal Investigation Division, the U.S. Postal Inspection Service, the Chicago Police Department Internal Affairs Division and the Illinois State Police into corruption in the judiciary of Cook County, Illinois (the Chicago jurisdiction). The FBI named the investigation "Operation Greylord" after the curly wigs worn by British judges. The Operation The 3 year and 8-month federal undercover operation took place in the 1980s, with the cooperation of some state and local law enforcement and judicial officials. After the end of the undercover phase, the Greylord trials lasted ten years. Over 92 public officials were indicted (almost all in federal court), and most eventually were convicted, either by guilty pleas or trials.
