Howard Olney
Howard William Olney (born 7 October 1934) is the Australian Aboriginal Lands Commissioner. Olney was born in Nedlands and attended Perth Modern School and the University of Western Australia. He was admitted as a solicitor in 1957 and as a magistrate in 1965, being called to the bar in 1974. He became Queen's Counsel in 1980 and served as a Labor member of the Western Australian Legislative Council from 1980 to 1982. From 1982 to 1988 he was a Justice of the Supreme Court of Western Australia, moving to the Federal Court from 1988 to 2003. There in 1998 he wrote the opinion that denied the Yorta Yorta native title claim in Members of the Yorta Yorta Aboriginal Community v Victoria. Supreme Court Of The Northern Territory
The Supreme Court of the Northern Territory is the superior court for the Australian Territory of the Northern Territory. It has unlimited jurisdiction within the territory in civil matters, and hears the most serious criminal matters. It is around the middle of the Australian court hierarchy. Early history Shortly after the first settlement at Palmerston, Port Darwin in 1869–70, pressure was placed upon the South Australian government to establish a superior court in the then Northern Territory of South Australia. Although such a court was mooted, it was decided to send judges to Palmerston on circuit. The first circuit court was held in February 1875. Thereafter, from 1875 to 1884, the government appointed persons as commissioners (usually the Government Resident) to exercise the power of a judge of the Supreme Court of South Australia in all but trials of capital offences. ''Yorta Yorta v Victoria'' was a native title claim by the Yorta Yorta, an Aboriginal Australian people of north central Victoria. The claim was dismissed by Justice Olney of the Federal Court of Australia in 1998. Appeals to the Full Bench of the Federal Court of Australia in 2001 and the High Court of Australia in 2002 were also dismissed. The determination by Justice Olney in 1998 ruled that the "tide of history" had "washed away" any real acknowledgement of traditional laws and any real observance of traditional customs by the applicants. An appeal was made to the full bench of the Federal Court on the grounds that "the trial judge erroneously adopted a 'frozen in time' approach" and "failed to give sufficient recognition to the capacity of traditional laws and customs to adapt to changed circumstances". The University of Western Australia (UWA) is a public research university in the Australian state of Western Australia.
