Henningsen V. Bloomfield Motors, Inc.
In ''Henningsen v. Bloomfield Motors, Inc.'', 32 N.J. 358, 161 A.2d 69 (N.J. 1960), the New Jersey Supreme Court held that an automobile manufacturer's attempt to use an express warranty that disclaimed an implied warranty of merchantability was invalid. Facts On May 7, 1955, Mr. Claus H. Henningsen purchased a Plymouth automobile, manufactured by Chrysler Corporation, from Bloomfield Motors, Inc. The automobile was intended as a Mother's Day gift to his wife, Helen, and the purchase was executed solely by Mr. Henningsen. The contract for sale was a one-page form and contained paragraphs in various type sizes on the front and back of the form. Mr. Henningsen testified he did not read all paragraphs of the contract. New Jersey Supreme Court
The Supreme Court of New Jersey is the highest court in the U.S. state of New Jersey. Bloomfield is a township in Essex County, New Jersey, United States. As of the 2020 United States Census, the township's population was 53,105. It surrounds the Bloomfield Green Historic District. History The initial patent for the land that would become Bloomfield Township was granted to the English Puritan colonists of Newark, and the area assigned to Essex County in 1675, and Newark Township in 1693. Plymouth (automobile)
Plymouth was a brand of automobiles produced by Chrysler, Chrysler Corporation and its successor Mercedes-Benz Group, DaimlerChrysler. The brand was launched in 1928 to compete in what was then described as the "low-priced" market segment that was dominated by Chevrolet and Ford Motor Company, Ford. It became a high-volume seller for the automaker until the late 1990s. Plymouth cars were marketed primarily in the United States. The brand was withdrawn from the marketplace in 2001.
