The title of Chief Justice of the Northern Territory refers to the highest judicial position in the Supreme Court of the Northern Territory. The position is currently held by Michael Grant. History of the Chief Justice of the Northern Territory The Supreme Court of the Northern Territory was established in 1911. From 1911–1974 the Northern Territory had only one resident judge. Relief was provided by Commonwealth judges from 1961 to 1976, and by Federal Court judges from 1976 to 1978. The Northern Territory gained Self-Government in 1978 and by that time had four resident judges. The title given to the judge varied in name, as the laws concerning the position varied. In 1975 the position was renamed to Chief Judge, with Sir William Forster the only person to hold that position, from 1977–1979. Thomas Alexander Wells
Thomas Alexander Wells (13 September 1954) was a judge of the Northern Territory Supreme Court in Darwin, Australia. He was known for having misdirected the jury in a high-profile case in 1934, which was later overturned in an appeal in the High Court of Australia known as '' Tuckiar v The King''. Career Wells was a court reporter for a Sydney newspaper. He served overseas in WWI and on returning to Australia studied law in Sydney, where he practised at the bar for nine years after graduating. In 1933 he was appointed Judge of the Supreme Court of the Northern Territory, following the retirement of Justice Mallam (1878–1954). Trevor Riley
Trevor John Riley (born 29 January 1948) was the Chief Justice of the Supreme Court of the Northern Territory in Australia. He was appointed a judge of the Supreme Court on 1 February 1999, Chief Justice on 27 September 2010 and retired on 4 July 2016. Justice Riley was born in Bruce Rock in Western Australia and was educated at the Merredin Senior High School and the University of Western Australia. After graduating with a Bachelor of Laws, he was admitted to practice in 1970. He relocated to Darwin in 1974. He worked with Ian Barker in the firm Withnall & Barker until 1974 when Cyclone Tracy destroyed Darwin. After the cyclone he joined the firm Ward Keller. Brian Ross Martin
Brian Ross Martin (born 2 September 1947) is an Australian jurist. He was a judge of the Supreme Court of South Australia before being appointed Chief Justice of the Supreme Court of the Northern Territory in 2004. He served in the Northern Territory between 2004 and 2010. He served as an acting Judge of the Supreme Court of Western Australia in 2012. In legal texts, he is referred to as "Martin (BR) CJ" to avoid confusion with his predecessor. Brian Frank Martin
Brian Frank Martin (2 November 1936 – 24 April 2023) was the fourth Chief Justice of the Supreme Court of the Northern Territory. He was appointed to that position on 26 February 1993 when the former Chief Justice Austin Asche took up appointment as Administrator of the Northern Territory. Chief Justice Martin was appointed a Judge of the Court in 1987 and, following his retirement, still assisted the Court as an Acting Judge having been appointed to that position in 2004. He was unusually succeeded as Chief Justice by a person bearing the same first name and surname, Justice Brian Ross Martin. The two men are distinguished by their middle names. Austin Asche
Keith John Austin Asche ( ; born 28 November 1925) is a former Administrator of the Northern Territory of Australia and was the third Chief Justice of the Supreme Court of the Northern Territory. Early years, education and family Asche was born in Melbourne, the son of Eric Thomas Asche and Beryl Victoria Asche (née Woinarski). Eric was the nephew of the actor Oscar Asche. In 1926, Eric Asche (father of Austin Asche) was appointed Legal Assistant in the Crown Law Office, Department of the Government Secretary for the Territory of New Guinea. They departed from Sydney on 25 August, and the family spent a year in Rabaul. Eric then successfully applied for a job in Darwin, and the family sailed on the SS Marella, arriving on 18 February 1928. Kevin O'Leary (judge)
Kevin Fredrick O'Leary QC (19 February 1920 – 3 August 2015) was the second Chief Justice of the Supreme Court of the Northern Territory. He was appointed to that position on 12 September 1985 after James Muirhead had acted in the position following the relocation to Perth of the Territory's first Chief Justice William Forster earlier that year. Education and early life Chief Justice O'Leary was born in Sydney, New South Wales, and attended the Christian Brothers' High School, Lewisham. He commenced studying law at the University of Sydney and joined the Australian Imperial Forces in 1940 and the Royal Australian Air Force in 1942. Sir Richard Arthur Blackburn
Sir Richard Arthur Blackburn, (26 July 1918 – 1 October 1987) was an Australian judge, prominent legal academic and military officer. He became a judge of three courts in Australia, and eventually became chief justice of the Australian Capital Territory. In the 1970s, he decided one of Australia's earliest Aboriginal Land rights cases. His service to the Australian legal community is commemorated by the annual Sir Richard Blackburn Memorial lectures in Canberra. Ross Ibbotson Dalton Mallam (1878 – 26 May 1954), invariably known as R. I. D. Mallam or Justice Mallam, was a judge of the Northern Territory Supreme Court. History Mallam was born in Kensington, London, and in 1902 emigrated to Adelaide, South Australia, where his uncle George Bessant Mallam (1843–1910) was a successful medical practitioner who had in 1884 married Annie Isabel Kyffin Thomas (1864–1948), daughter of the influential newspaper proprietor William Kyffin Thomas (1821–1878). He began practising law in Kadina in 1903, then a year later in Adelaide, where he also served as managing clerk for Paris Nesbit. On a motion by Nesbit, Mallam was admitted as a practitioner to the Supreme Court of South Australia. The Supreme Court of the Northern Territory is the superior court for the Australian Territory of the Northern Territory. It has unlimited jurisdiction within the territory in civil matters, and hears the most serious criminal matters. It is around the middle of the Australian court hierarchy. Early history Shortly after the first settlement at Palmerston, Port Darwin in 1869–70, pressure was placed upon the South Australian government to establish a superior court in the then Northern Territory of South Australia. Although such a court was mooted, it was decided to send judges to Palmerston on circuit. The first circuit court was held in February 1875. Thereafter, from 1875 to 1884, the government appointed persons as commissioners (usually the Government Resident) to exercise the power of a judge of the Supreme Court of South Australia in all but trials of capital offences.
