California Penal Code Section 597t
Section 597t of the Penal Code of California is a California State criminal law which requires that animals confined in enclosed areas be provided with an adequate exercise area. Even though this section of the Penal Code does not define "adequate exercise area", it would seem to prohibit the confinement of calves in veal crates, as well as the confinement of hens in battery cages and the confinement of sows in gestation crates. However, this law seems to have never been enforced. There is not a single court case in California where a defendant was found guilty of or even prosecuted for violating 597t. Because this law has never been applied in a court case, there is no precedential standard according to which animal confinement may be judged. Since 597t is a criminal law, it may not be enforced by private entities through civil action, and may only be enforced by a public prosecutor filing a criminal action, or by corporations formed for the prevention of cruelty to animals ... Gestation Crate
A gestation crate, also known as a sow stall, is a metal enclosure in which a farmed sow used for breeding may be kept during pregnancy.Wilson G. Pond, Fuller W. Bazer, Bernard E. Rollin (eds.), ''Animal Welfare in Animal Agriculture'', CRC Press, 2011, p. 151ff. A standard crate measures 6.6 ft x 2.0 ft (2 m x 60 cm). Sow stalls contain no bedding material and are instead floored with slatted plastic, concrete or metal to allow waste to be efficiently collected below. This waste is then flushed into open-air pits known as lagoons.Marc Kaufmann"In Pig Farming, Growing Concern, Raising Sows in Crates Is Questioned" ''The Washington Post'', 18 June 2001. A few days before giving birth, sows are moved to farrowing crates where they are able to lie down, with an attached crate from which their piglets can nurse. There were 5.36 million breeding sows in the United States as of 2016, out of a total of 50.1 million pigs. Most pregnant sows in the US are kept in ... 2018 California Proposition 12
Proposition 12 ("Prop 12") was a California ballot proposition in that state's general election on November 6, 2018. The measure was self-titled the Prevention of Cruelty to Farm Animals Act. The measure passed, by a vote of about 63% Yes to 37% No. The proposition establishes new minimum requirements on farmers to provide more space for egg-laying hens, breeding pigs, and calves raised for veal. California businesses will be banned from selling eggs or uncooked pork or veal that came from animals housed in ways that did not meet these requirements. The ballot measure aimed to build upon and strengthen the requirements of a previous ballot measure, the 2008 California Proposition 2, which prohibited battery cages and gestation crates for animals in California, and required that pigs, hens, and calves be able to spread their wings or limbs and turn around. The California legislature in 2010 passed AB 1437, which required all shell eggs sold in the state to meet the same require ... Animal Welfare
Animal welfare is the well-being of non-human animals. Formal standards of animal welfare vary between contexts, but are debated mostly by animal welfare groups, legislators, and academics. Animal welfare science uses measures such as longevity, disease, immunosuppression, behavior, physiology, and reproduction, although there is debate about which of these best indicate animal welfare. Respect for animal welfare is often based on the belief that nonhuman animals are sentient and that consideration should be given to their well-being or suffering, especially when they are under the care of humans. These concerns can include how animals are slaughtered for food, how they are used in scientific research, how they are kept (as pets, in zoos, farms, circuses, etc.), and how human activities affect the welfare and survival of wild species. There are two forms of criticism of the concept of animal welfare, coming from diametrically opposite positions. One view, held by some think ... California Proposition 64 (2004)
{{ElectionsCA Proposition 64 was a California ballot proposition on the November 2, 2004 ballot. It passed with 6,571,694 (59.0%) votes in favor and 4,578,725 (41.0%) against. It was an initiative statute that limited the California law on unfair competition, restricting private lawsuits against a company only to those where an individual is injured by and suffers a financial loss due to an unfair, unlawful, or fraudulent business practice and providing that otherwise only public prosecutors may file lawsuits charging unfair business practices. Proponents argued that the measure would limit "frivolous lawsuits" against companies, which they claimed result mainly in a windfall for lawyers rather than consumers. Proponents also argued that businesses ultimately must pass along their costs in the form of higher prices to consumers. Opponents charged that the proposition was heavily funded by businesses who wanted to weaken consumer rights by limiting Californians' ability to enforce ... Criminal Law
Criminal law is the body of law that relates to crime. It prescribes conduct perceived as threatening, harmful, or otherwise endangering to the property, health, safety, and moral welfare of people inclusive of one's self. Most criminal law is established by statute, which is to say that the laws are enacted by a legislature. Criminal law includes the punishment and rehabilitation of people who violate such laws. Criminal law varies according to jurisdiction, and differs from civil law, where emphasis is more on dispute resolution and victim compensation, rather than on punishment or rehabilitation. Criminal procedure is a formalized official activity that authenticates the fact of commission of a crime and authorizes punitive or rehabilitative treatment of the offender. History The first civilizations generally did not distinguish between civil law and criminal law. The first written codes of law were designed by the Sumerians.
