California Administrative Procedure Act
The California Administrative Procedure Act (APA) is a series of acts of the California Legislature first enacted 15 June 1945 that requires California state agencies to adopt regulations in accordance with its provisions. It predates the federal Administrative Procedure Act that was enacted almost a year later on 11 June 1946. Overview The act allows the public to participate in the adoption of state regulations in order to ensure that the regulations are clear, necessary, and legally valid. The act allows that, as long as a person is not limited by a statute, any interested person can petition a state agency to change regulation. These changes include the adoption of a new regulation or the amendment or repeal of an existing one. According to the act, an agency can adopt a new regulation only if it is within their scope of authority and consistent with state law. The California State Legislature is a bicameral state legislature consisting of a lower house, the California State Assembly, with 80 members; and an upper house, the California State Senate, with 40 members. Both houses of the Legislature convene at the California State Capitol in Sacramento. The California state legislature is one of just ten full-time state legislatures in the United States. The California Code of Regulations (CCR, Cal. Code Regs.) is the codification of the general and permanent rules and regulations (sometimes called administrative law) announced in the ''California Regulatory Notice Register'' by California state agencies under authority from primary legislation in the California Codes. Such rules and regulations are reviewed, approved, and made available to the public by the Office of Administrative Law (OAL), and are also filed with the Secretary of State. California Regulatory Notice Register
The ''California Regulatory Notice Register'' (Notice Register or ''Z Register'') contains notices of proposed regulatory actions by California state agencies to adopt, amend, or repeal regulations contained in the ''California Code of Regulations'' (CCR). It is similar to the role of the ''Federal Register''. A state agency must complete its rulemaking and submit the rulemaking file to the California Office of Administrative Law (OAL) within one year of the date of publication of a "Notice of Proposed Action" in the Notice Register. The OAL publishes the Notice Register every Friday. Unlike the ''Federal Register'', California regulations are not normally published in the Notice Register, meaning that until they are codified in the CCR they must be obtained from the individual agencies or elsewhere. The Administrative Procedure Act (APA), , is the United States federal statute that governs the way in which administrative agencies of the federal government of the United States may propose and establish regulations and it grants U.S. federal courts oversight over all agency actions. According to Hickman & Pierce, it is one of the most important pieces of United States administrative law, and serves as a sort of "constitution" for U.S. administrative law.
