Brewer V. Williams
''Brewer v. Williams'', 430 U.S. 387 (1977), is a decision by the United States Supreme Court that clarifies what constitutes "waiver" of the right to counsel for the purposes of the Sixth Amendment. Under ''Miranda v. Arizona'', evidence obtained by police during interrogation of a suspect before he has been read his Miranda rights is inadmissible. Here, however, the defendant had been indicted in court and had asserted his desire to have counsel, thus his Sixth Amendment right to counsel had attached. At issue was whether a voluntary admission of incriminating facts in response to police statements made while the defendant was in custody and outside the presence of his lawyer constituted a waiver of this right to counsel. Sian Emma O'Callaghan (3 June 1988 – March 2011) was a 22-year-old British woman who disappeared from Swindon, Wiltshire, having last been seen at a nightclub in the town in the early hours of 19 March 2011. Her body was found on 24 March 2011 near Uffington in Oxfordshire. On 19 October 2012, at Bristol Crown Court, Christopher Halliwell, 48, of Nythe, Swindon pleaded guilty to O'Callaghan's murder. Potter Stewart (January 23, 1915 – December 7, 1985) was an American lawyer and judge who served as an Associate Justice of the United States Supreme Court from 1958 to 1981. During his tenure, he made major contributions to, among other areas, criminal justice reform, civil rights, access to the courts, and Fourth Amendment jurisprudence. After graduating from Yale Law School in 1941, Stewart served in World War II as a member of the United States Navy Reserve. After the war, he practiced law and served on the Cincinnati city council. In 1954, President Dwight D. Eisenhower appointed Stewart to a judgeship on the U.S. Court of Appeals for the Sixth Circuit.
