António Castanheira Neves
António Castanheira Neves (born 8 November 1929 in Tábua) is a Portuguese legal philosopher and a professor emeritus at the law faculty of the University of Coimbra. According to Castanheira Neves, law can only be understood through ''legal problems'' (roughly, legal cases), which have to be solved within the legal system (including a necessary connection to morality). Law, he claims, is not something given or previous, but the solution to legal problems. Legal problems are the decisive starting point. His opposition to positivism, to natural law and to the several theories of legal syllogism would make him one of the first and most accomplished advocates of interpretivism. Castanheira Neves, however, has always claimed that law — the task of lawyers — is not essentially interpretive or hermeneutical, but practical, ''i.e.'', action guiding. In Portuguese law, the assentos (literally, ''settlements'') were general obligatory rules expressed in some of the decisions of the Supreme Court of Justice. Hans-Georg Gadamer (; ; February 11, 1900 – March 13, 2002) was a German philosopher of the continental tradition, best known for his 1960 ''magnum opus'', '' Truth and Method'' (''Wahrheit und Methode''), on hermeneutics. Life Family and early life Gadamer was born in Marburg, Germany, the son of Johannes Gadamer (1867–1928), a pharmaceutical chemistry professor who later also served as the rector of the University of Marburg. He was raised a Protestant Christian. Gadamer resisted his father's urging to take up the natural sciences and became more and more interested in the humanities. His mother, Emma Karoline Johanna Geiese (1869–1904) died of diabetes while Hans-Georg was four years old, and he later noted that this may have had an effect on his decision to not pursue scientific studies. Moral Particularism
Moral particularism is a theory in meta-ethics that runs counter to the idea that moral actions can be determined by applying universal moral principles. It states that there is no set of moral principles that can be applied to every situation, making it an idea appealing to the causal nature of morally challenging situations. Moral judgements are said to be determined by factors of relevance with the consideration of a particular context. A moral particularist, for example, would argue that homicide cannot be judged to be morally wrong until all the morally relevant facts are known. While this stands in stark contrast to other prominent moral theories, such as deontology, consequentialism, and virtue ethics, it finds its way into jurisprudence, with the idea of justifiable homicide, for instance. Jonathan Peter Dancy (born 8 May 1946) is a British philosopher, who has written on ethics and epistemology. He is currently Professor of Philosophy at University of Texas at Austin and Research Professor at the University of Reading. He taught previously for many years at the University of Keele.
