1938 South Dakota Gubernatorial Election
The 1938 South Dakota gubernatorial election was held on November 8, 1938. Incumbent Republican Governor Leslie Jensen declined to seek re-election and instead unsuccessfully ran for the U.S. Senate. Harlan J. Bushfield, the former Chairman of the South Dakota Republican Party, won the Republican primary to succeed Jensen. In the general election, he faced Democratic nominee Oscar Fosheim, a State Representative from Miner County, in the general election. John Marshall Harlan (June 1, 1833 â October 14, 1911) was an American lawyer and politician who served as an Associate Justice of the Supreme Court of the United States, associate justice of the Supreme Court of the United States, U.S. Supreme Court from 1877 until his death in 1911. He is often called "The Great Dissenter" due to his many dissents in cases that restricted civil liberties, including the ''Civil Rights Cases'', ''Plessy v. Ferguson'', and ''Giles v. Harris''. Many of Harlan's views expressed in his notable dissents would become the official view of the Supreme Court starting from the 1950s Warren Court and onward. Leslie Jensen
Leslie Jensen (September 15, 1892 – December 14, 1964) was an American businessman and politician who served as the 15th Governor of South Dakota. Early life and military career Leslie Jensen was born in Hot Springs, South Dakota. In 1916 and 1917, he was a Second Lieutenant in the South Dakota National Guard 4th Infantry Regiment during the 1916 Mexican border expedition. From 1917 to 1919 he was a Captain in the 147th Artillery Regiment with the American Expeditionary Forces. He received an LL.B. degree from the University of South Dakota School of Law in 1921. He married Elizabeth Ward and they had three children. Career From 1922 until 1934 Jensen was a collector for the Internal Revenue Service. The 1938 United States Senate elections in South Dakota took place on November 8, 1938. Incumbent Republican Senator Peter Norbeck died in office on December 20, 1936. Herbert E. Hitchcock was appointed by Governor Tom Berry as Norbeck's replacement. Two elections for the same Senate seat were held on the same day; one as a special election to fill the remainder of Norbeck's six-year term, and another to select a Senator to serve the next six-year term. In the regularly scheduled election, Hitchcock ran for re-election for a full term, but was overwhelmingly defeated in the Democratic primary by former Governor Berry. Miner County is a county in the U.S. state of South Dakota. As of the 2020 census, the population was 2,298. Its county seat is Howard. The county was created in 1873 and organized in 1880. History The area is situated on the site of Dakota Sioux trails that connected two sites of cultural significance to the Dakota people, the pipestone quarries in southwestern Minnesota and the Sioux Crossing of the Three Rivers, near present-day Fort Thompson. South Dakota Highway 34 now roughly follows this route. The Fort Ridgely and South Pass Wagon Road, also known as Nobles Trail, the first road in Dakota Territory, passed through the area.
