Exemptions
Articles 2.3 and 2.6 exempt AI systems used for military or national security purposes or pure scientific research and development from the AI Act. In particular, the Regulation does not apply where AI systems are used exclusively for military, defence or national security purposes, or to systems developed and put into service solely for scientific research and development; if such systems are later used for other purposes (for example, civilian or law-enforcement uses), the Act applies. These activities remain governed by separate EU and national rules on defence, security, and intelligence rather than by the AI Act itself.
