, though Gibson's lawyers asked for more serious charges to be brought. The Cases were released on bond one day after being charged. In November 2022, the aggravated assault charges were upgraded to attempted first-degree murder and Gibson's lawyers have called for a federal hate crime probe into the shooting. The trial began on August 15, 2023. However, two days later the judge granted the defense motion for a mistrial citing a video not being turned over to the prosecution or defense by the Brookhaven Police Department. A second trial was scheduled to start in April 2025.
