Offences Against The State Acts 1939–1998
The Offences Against the State Acts 1939–1998 form a series of laws passed by the Irish Oireachtas. Offences under the Act The Act criminalises many actions deemed detrimental to state security. An organisation can be made subject to a suppression order under the act, after which being a member of or directing the activities of such an unlawful organisation becomes an offence. The opinion of a senior Garda can be admitted as prima facie evidence of membership. The act also criminalises obstruction of the President or government, secret societies in the police or army and unauthorised demonstrations in the vicinity of the Oireachtas, the Irish parliament. The Oireachtas ( ; ), sometimes referred to as Oireachtas Éireann, is the Bicameralism, bicameral parliament of Republic of Ireland, Ireland. The Oireachtas consists of the president of Ireland and the two houses of the Oireachtas (): a house of representatives called Dáil Éireann and a senate called Seanad Éireann. The houses of the Oireachtas sit in Leinster House in Dublin, an eighteenth-century Duke, ducal palace. The directly elected Dáil is the more powerful of the houses of the Oireachtas. District Court (Ireland)
The District Court () is the lowest court in the Irish court system and the main court of summary jurisdiction in Ireland. It has responsibility for hearing minor criminal matters, small civil claims, liquor licensing, and certain family law applications. It is also responsible for indicting the accused and sending them forward for trial at the Circuit Court and Central Criminal Court. Jurisdiction The District Court is a court of local and limited jurisdiction. The civil jurisdiction is limited to damages not exceeding €15,000; the court has no equitable jurisdiction. The court has the power to renew licences for the sale of intoxicating liquor and grant licences for lotteries. The family jurisdiction of the court includes the power to award guardianship, grant protection or barring orders, and award maintenance of up to €150 a week per child, €500 per week for a spouse or a lump sum up to €15,000. Detention (imprisonment)
Detention is the process whereby a state or private citizen holds a person by removing or restricting their freedom or liberty at that time. Detention can be due to (pending) criminal charges against the individual pursuant to a prosecution or to protect a person or property. Being detained does not always result in being taken to a particular area (generally called a detention center), either for interrogation or as punishment for a crime (see prison). Persons can be detained if they are not allowed to leave a specific jurisdiction (a type of travel ban known as an 'exit ban') or if they are prevented from traveling to or from a specific area or region. An individual may be detained due a psychiatric disorder, potentially to treat this disorder involuntarily.
