Section 295A
Section 295A of the Indian Penal Code lays down the punishment for the deliberate and malicious acts, that are intended to outrage religious feelings of any class by insulting its religion or religious beliefs. It is one of the Hate speech laws in India. This law prohibits blasphemy against all religions in India. Section 295A is a cognisable, non-bailable, and non-compoundable offence. Legal experts consider Section 295A a controversial provision. They believe that there are good legal arguments for the court to revisit and consider overruling the constitution bench judgement in ''Ramji Lal Modi v. State of UP''. Indian Penal Code
The Indian Penal Code (IPC) is the official criminal code of India. It is a comprehensive code intended to cover all substantive aspects of criminal law. The code was drafted on the recommendations of first law commission of India established in 1834 under the Charter Act of 1833 under the chairmanship of Thomas Babington Macaulay. It came into force in British India during the early British Raj period in 1862. However, it did not apply automatically in the Princely states, which had their own courts and legal systems until the 1940s. The Code has since been amended several times and is now supplemented by other criminal provisions. After the partition of the British Indian Empire, the Indian Penal Code was inherited by India and Pakistan, where it continues independently as the Pakistan Penal Code. Mohammed Zubair is an Indian journalist and the co-founder of Alt News, an Indian non-profit fact-checking website. Zubair was arrested and incarcerated by the Delhi Police for a month. His detention raised further concerns about the state of India's press freedom under Narendra Modi's premiership and was widely criticized by journalistic bodies, human rights organizations and the political opposition who allege that the arrest was an act of revenge against his role in Alt News' work of combating disinformation. Alt News is an Indian non-profit fact checking website founded and run by former software engineer Pratik Sinha and Mohammed Zubair. It was launched on 9 February 2017 to combat fake news. 2022 BJP Muhammad Remarks Controversy
The 2022 Muhammad remarks row began on 27 May 2022, when Nupur Sharma, a spokeswoman of India's ruling party, Bharatiya Janata Party (BJP), insinuated that the Islamic Prophet Muhammad was a pedophile, on a Times Now debate on the Gyanvapi Mosque dispute, against the counterparty who allegedly poked fun at the disputed Shivalinga, referring to it as a Fountain. In response to the remarks, (perceived to be derogatory to Hindu god Shiva), Nupur insinuated that Prophet Muhammad was a pedophile, in reference to Muhammad and his third wife, Aisha, who, some islamic sources purport, to be six years of age at the time of their marriage and the consummation of said marriage. The Gyanvapi Mosque is located in Varanasi, Uttar Pradesh, India. It was constructed by Aurangzeb in 1669 upon demolition of an older Shiva temple. Hate Speech Laws In India
The hate speech laws in India aim to prevent discord among its many ethnic and religious communities. The laws allow a citizen to seek the punishment of anyone who shows the citizen disrespect "on grounds of religion, race, place of birth, residence, language, caste or any other ground whatsoever". The Constitution The Constitution of India does not provide for a state religion. Article 25(1) states, "Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and the right freely to profess, practise and propagate religion".
