''United States v. Haymond'', 588 U.S. ___ (2019), is a case in which the U.S. Supreme Court struck down the five-year mandatory minimum prison sentence for certain sex offenses committed by federal supervised releases under as unconstitutional unless the charges are proven to a jury beyond a reasonable doubt. Justices Ginsburg, Sotomayor, and Kagan joined Gorsuch's plurality opinion, while Breyer provided the necessary fifth vote with his narrow concurrence that began by saying he agreed with much of Justice Alito's dissent, which was joined by Justices Roberts, Thomas, and Kavanaugh. The Court was considering whether Congress can require mandatory minimum prison sentences that exceed the minimum for the original offense, and allow maximum prison sentences that exceed the maximum for the original offense, in federal supervised release revocation cases where the facts were not proven to a jury beyond a reasonable doubt. Adversarial System
The adversarial system or adversary system is a legal system used in the common law countries where two advocates represent their parties' case or position before an impartial person or group of people, usually a judge or jury, who attempt to determine the truth and pass judgment accordingly. It is in contrast to the inquisitorial system used in some civil law systems (i.e. those deriving from Roman law or the Napoleonic code) where a judge investigates the case. The adversarial system is the two-sided structure under which criminal trial courts operate, putting the prosecution against the defense. Good Time Credit
Good conduct time, good time credit, good time, or time off for good behavior is a sentence reduction given to prisoners who maintain good behavior while imprisoned. Good time can be forfeited if a prisoner is determined to have committed disciplinary infractions and/or crimes while incarcerated. Under United States federal law, prisoners serving more than one year in prison get 54 days a year of good time on the anniversary of each year they serve plus the pro rata good time applied to a partial year served at the end of their sentence, at the rate of 54 days per year. Elena Kagan ( ; born April 28, 1960) is an American lawyer who serves as an associate justice of the Supreme Court of the United States.
