''Oracle Corp v. SAP AG'', No. 4:07-cv-01658, was a United States District Court for the Northern District of California case in which Oracle sued SAP, alleging that SAP had engaged in copyright infringement by downloading thousands of copyrighted documents and programs from Oracle's Customer Connection website. SAP admitted that its subsidiary TomorrowNow had infringed Oracle's copyrights and a jury awarded Oracle record-high damages in the amount of $1.3 billion. Judge Phyllis Hamilton later vacated the jury's verdict, which was based on the calculation of a hypothetical license, and granted SAP's motion for a new trial dependent on Oracle rejecting a remittitur of $272 million. J.D. Edwards World Solution Company or JD Edwards, abbreviated JDE, was an enterprise resource planning (ERP) software company, whose namesake ERP system is still sold under ownership by Oracle Corporation. Remittitur
In United States law, remittitur (Latin: "it is sent back") is a ruling by a judge (usually upon motion to reduce or throw out a jury verdict) lowering the amount of damages granted by a jury in a civil case. The term is sometimes used where a judgment exceeds the amount demanded by the prevailing party, or for a reduction in awarded damages even when the amount awarded did not exceed the amount demanded but is otherwise considered excessive. The term originally denoted a procedural device in English common law, although it has long fallen into disuse in England and other common law jurisdictions, and it has evolved in American use to serve a different function than it originally performed in England. If the motion is granted, the plaintiff may either accept the reduced verdict or submit to a new trial restricted to the matter of damages.
