Texas Open Beaches Act
The Texas Open Beaches Act is a U.S. state of Texas law, passed in 1959 and amended in 1991, which guarantees free public access to beaches on the Gulf of Mexico: ''The public... shall have the free and unrestricted right of ingress and egress to and from the state-owned beaches bordering on the seaward shore of the Gulf of Mexico ... extending from the line of mean low tide to the line of vegetation bordering on the Gulf of Mexico.'' After major storms, Texas GLO guidelines indicate that beachfront residents may not rebuild their homes due to the act such as some Galveston homes affected by Hurricane Alicia in 1983. Additionally, repairs may only be made in certain circumstances, and then only on structures above the mean high-tide line. Ongoing litigation continues to clarify the effect of the act on beachfront property owners. Hurricane Alicia
Hurricane Alicia was a small but powerful tropical cyclone that caused significant destruction in the Greater Houston area of Southeast Texas in August 1983. Although Alicia was a relatively small hurricane, its track over the rapidly growing metropolitan area contributed to its $3 billion damage toll, making it the costliest Atlantic hurricane at the time. Alicia spawned from a disturbance that originated from the tail-end of a cold front over the northern Gulf of Mexico in mid-August 1983. The cyclone was named on August 14 when it became a tropical storm, and the combination of weak steering currents and a conducive environment allowed Alicia to quickly intensify as it drifted slowly westward. On August 17, Alicia became a hurricane and continued to strengthen, topping out as a Category 3 major hurricane as it made landfall on the southwestern end of Galveston Island. The public trust doctrine is the principle that the sovereign holds in trust for public use some Natural resource, resources such as shoreline between the high and low tide lines, regardless of private property ownership. Origins The Roman law, ancient laws of the Byzantine Emperor Justinian held that the sea, the shores of the sea, the air and running water were common to everyone. The Coast, seashore, later defined as waters affected by the ebb and flow of the tides could not be appropriated for private use and was open to all. This principle became the law in England as well. Centuries later, ''Magna Carta'' further strengthened public rights. At the insistence of English Nobility, nobles, fishing weirs which obstructed free navigation were to be removed from rivers. These rights were further strengthened by later laws in England and subsequently became part of the common law of the United States.
